Abstract

Public trust in police institutions is an important foundation in maintaining social stability and security. If the public believes that the police work transparently and fairly, then public support for various law enforcement actions will be stronger. This research aims to examine the relationship between transparency in the investigation process and public trust in police institutions. By using a normative research method that looks at the conformity between provisions in positive law and implementation in law enforcement. The research results show that the level of investigative transparency has a significant influence on public trust in the police. People who believe more in the transparency of the investigative process tend to have higher trust in police institutions. The discussion of the results of this research also discusses practical implications and challenges in implementing transparency in the police, as well as providing recommendations for public policies that can increase investigative transparency. This research shows that transparency is an important key in building public trust in police institutions. Kepercayaan publik terhadap institusi kepolisian merupakan fondasi yang penting dalam menjaga stabilitas sosial dan keamanan. Apabila masyarakat percaya bahwa kepolisian bekerja dengan transparan dan adil, maka dukungan publik terhadap berbagai tindakan penegakan hukum akan lebih kuat. Penelitian ini bertujuan untuk mengkaji hubungan antara transparansi dalam proses penyidikan dengan kepercayaan publik terhadap institusi kepolisian. Dengan menggunakan metode penelitian normatif yang melihat kesesuaian antara ketentuan dalam hukum positif dengan implementasi dalam penegakan hukum.Hasil penelitian menunjukkan bahwa tingkat transparansi penyidikan memiliki pengaruh signifikan terhadap kepercayaan publik terhadap kepolisian. Masyarakat yang lebih percaya pada transparansi proses penyidikan cenderung memiliki kepercayaan yang lebih tinggi terhadap institusi kepolisian. Diskusi hasil penelitian ini juga membahas implikasi praktis dan tantangan dalam menerapkan transparansi di kepolisian, serta memberikan rekomendasi untuk kebijakan publik yang dapat meningkatkan transparansi penyidikan. Penelitian ini menunjukkan bahwa transparansi adalah kunci penting dalam membangun kepercayaan publik terhadap institusi kepolisian.

Abstract

This study aims to analyze the shift in legal paradigms and evidentiary issues related to the criminalization of black magic in Law Number 1 of 2023 concerning the Criminal Code (New Criminal Code). The phenomenon of supernatural powers has long been a social reality in Indonesia, but often causes conflict due to limited regulations in the old Criminal Code. This study uses a qualitative descriptive-analytical method to examine the legal transformation in Article 252 of the New Criminal Code, which classifies the practice of supernatural powers as a crime against public order. The results show that the article uses a formal criminal offense construction, namely emphasizing the act of admitting, offering, or promising the services of supernatural powers that can cause physical or mental suffering. This approach is a pragmatic solution to overcome the difficulty of proving a causal relationship between the practice of black magic and its impacts scientifically. This study concludes that this criminalization provides legal certainty for the practice of shaman fraud, but still has the potential to cause injustice due to subjective interpretations of judges and differences between modern legal reasoning and public beliefs. Therefore, innovation in the justice system is needed through the integration of cross-disciplinary expert testimony to strengthen evidence without ignoring the socio-cultural values of society.
