Abstract

Environmental injustice and the fulfillment of the right to the environment have a relationship with each other. Environmental injustice is a real violation of the right to the environment and an inhibiting factor in fulfilling the right to the environment. Therefore, obstacles in fulfilling the right to the environment are related to environmental injustice. This study was conducted to examine the fulfillment of the right to the environment within the framework of environmental justice taxonomy which sees environmental justice as distributive justice, corrective justice, procedural justice, and social justice. This research is doctrinal legal research with a conceptual approach. The results of this study show that in the context of fulfilling the right to the environment, obstacles can be caused by distributive injustice in the form of unfair distribution of environmental benefits and risks, corrective injustice that causes weak legal protection for people’s environmental right, procedural injustice that hinders access to information, access to participation, and access to justice, and social injustice due to problems that still occur in the previous three aspects. In fact, the four aspects of environmental justice must be realized in order to fulfill the right to the environment as part of human rights.

Abstract

Before the enactment of Supreme Court Regulation (PERMA) No.1/2023, there was conceptual confusion regarding the application of strict liability in civil environmental cases. Firstly, misconceptions were indicated in the practice that required the plaintiff to prove that the defendant had committed an unlawful act (PMH). Secondly, there was an interpretation equating strict liability with shifting the burden of proof concerning fault elements. This research aims to analyze the significance of PERMA No.1/2023 in addressing these misconceptions. This is a doctrinal legal research. The findings indicate that PERMA No.1/2023 has provided normative guidelines and clarity, particularly for judges, in handling civil environmental cases that involve strict liability. Article 38 paragraph (3) of PERMA No.1/2023, which specifies what needs to be proven by the plaintiff when invoking strict liability as a basis for liability, addresses the first misconception. In this context, it is clear that the element of fault/unlawful act is irrelevant under strict liability. Meanwhile, Article 40 paragraph (1) of the PERMA emphasizes that strict liability is distinct from shifting the burden of proof concerning fault elements.

Abstract

Abstract This article aims to uncover the pathology in public participation practices using Habermas's concept of deliberative democracy as well as examine the rationality of the actors involved in public participation activities in environmental affairs. Next, an answer will be given on how decisions should be made in a sketch of a healthy public sphere and procedural environmental justice. This research blends juridical and philosophical approaches. The results of this research show that there is still a pathology in the public sphere in the form of the dominance of instrumental ratios that lead to strategic action, the closure of space for practical discourse, and the stuttering in sorting out the idea of the good and the idea of the right. To overcome these problems, decision-making must take place in an open public sphere and guarantee freedom of expression, access to participation, and the right to examine each other's claims so that the resulting consensus is truly legitimate and intersubjectively acceptable. Abstrak Penelitian ini bertujuan untuk mengungkap patologi dalam praktik-praktik partisipasi publik menggunakan konsep demokrasi deliberatif dari Habermas sekaligus menguji rasionalitas dari para aktor yang terlibat dalam aktivitas partisipasi publik dalam urusan lingkungan hidup. Selanjutnya, akan diberikan jawaban tentang bagaimana seharusnya keputusan dibuat dalam sketsa ruang publik yang sehat dan berkeadilan lingkungan prosedural. Penelitian ini memadukan pendekatan yuridis dan filosofis. Hasil dari penelitian ini menunjukkan bahwa masih terdapat patologi dalam ruang publik berupa dominasi rasio instrumental yang mengarah kepada tindakan strategis, tertutupnya ruang untuk melakukan diskursus praktis, dan adanya kegagapan dalam memilah the idea of the good dan the idea of the right. Untuk mengatasi problem yang terjadi, keputusan harus dibuat di ruang publik yang terbuka dan terdapat jaminan terhadap kebebasan mengeluarkan pendapat, akses partisipasi, dan hak untuk saling menguji klaim-klaim yang ada agar konsensus yang dihasilkan benar-benar legitim dan dapat diterima secara intersubjektif.
