Abstract

In recent years, forest fires have frequently occurred in Indonesia, especially forests in Sumatra and Kalimantan. Not only that the certain impacts of forest fires have damaged the forest and land ecosystems, the emergence of thick smokes polluting the air as a direct result of forest and land fires has led to the emergence of new disasters. The accumulation of smokes did not only occur at the location of the fire, but it had spreaded throughout almost the entire island of Sumatra, Kalimantan and parts of Java. It had even reached the closest neighbouring countries. Areas in Malaysia, Singapore and Brunei Darussalam were likewise affected by the smokes. These forest fires are the cause of transboundary air pollution which is contrary to the principles of international environmental law. One of the Principles of International Environmental Law is well-known as "Sic Utere Tuo Ut Alienum Non Laedes" which dictates that a country is prohibited from carrying out or allowing activities that could harm other countries. The consequences of these violations can be the basis for holding accountable the states that have committed acts that are detrimental to other countries. Another related principles is "The Polluter Pays Principles" which determines that the one who pollutes is the one who is obligated to pay.

Abstract

Masyarakat Ekonomi ASEAN merupakan tujuan akhir dari integrasi ekonomi yang termuat dalam Visi ASEAN 2020 dan selanjutnya dimuat dalam Cetak Biru Masyarakat Ekonomi ASEAN 2025. Tahap awal ditandai dengan adanya sebuah pasar bersama dan basis produksi tunggal melalui pergerakan barang, jasa dan investasi, tenaga kerja serta modal yang lebih bebas. ASEAN telah membuat kesepakatan di bidang perdagangan jasa yaitu Kerangka Persetujuan Jasa ASEAN (ASEAN Framework Agreement on Services/ AFAS) tahun 1995 dimana  Perjanjian AFAS memberikan pedoman bagi negara-negara ASEAN untuk meningkatkan Akses Pasar secara progresif dan menjamin Perlakuan Nasional yang setara bagi para penyedia jasa di kawasan ASEAN. AFAS bertujuan untuk mendorong liberalisasi perdagangan jasa di kawasan ASEAN khususnya dalam Masyarakat Ekonomi ASEAN dengan menetapkan 5 (lima) sektor jasa prioritas dari 12 sektor prioritas integrasi  barang dan jasa yang akan diliberalisasi menjelang pembentukan Masyarakat Ekonomi ASEAN yaitu: Jasa Kesehatan, Jasa Pariwisata, e-ASEAN, Jasa Logistik dan Jasa Transportasi Udara. Sedangkan mekanisme sistem pelaksanaan AFAS dalam rangka  liberalisasi perdagangan jasa di kawasan ASEAN dilakukan lebih memilih melalui rangkaian negosiasi dibawah Coordinating Committee on Service (CCS). Komite Kordinasi Jasa (Coordinating Committee on Services / CCS) dimaksudkan untuk menghapus secara substansial hambatan-hambatan perdagangan jasa antara negara-negara ASEAN guna meningkatkan efisiensi dan daya saing para penyedia jasa ASEAN. Pemerintah Indonesia telah menetapkan Undang-Undang No. 7 Tahun 2014 tentang Perdagagan. Dalam hal ini, ada tiga pasal yang mengatur tentang bidang jasa dalam UU Perdagangan terbaru dan menjadi bagian penting dalam pelaksanaan Masyarakat Ekonomi ASEAN yakni pasal 4 ayat (2), pasal 20 dan pasal 21. Namun secara lebih jauh, perjanjian AFAS ini tentu memberikan tantangan dan peluang bagi Indonesia di sektor perdagangan jasa. Tantangan terbesarnaya salah satunya adalah mempersiapkan sumber daya manusia yaitu tenaga kerja yang terampil dan kompeten sehingga dapat bersaing dengan ASEAN lainnya. Sedangkan peluang bagi Indonesia diantaranya denga jumlah penduduk yang besar jelas merupakan peluang bagi sumber daya manusia Indonesia untuk masuk dan berdagang jasa sampai ke wilayah negara anggota ASEAN lainnya.

Abstract

Human Rights which are naturally given by Allah since the birth of every human being into the world, as a right that cannot be changed and revoked by any power. The implementation of human rights must be in accordance with the applicable legal rules within the scope of the international community and the national community in a country. Various applicable international legal rules related to human rights that initiated by the United Nations are already owned by the international community, starting from the establishment of the Universal Declaration on Human Rights, the International Covenant on Economic, Social and Cultural Rights and the International Covenant on Civil and Political Rights. Economic, social and cultural rights include the right to work, the right to earn wages and the right to participate in trade unions, social related human rights, for example the right to social security, the right to housing and the right to education and cultural rights are rights related to the culture owned by a society or traditional culture.

Abstract

In the few months there is a high intensity of illegal fishing at Indonesian waters. The most potential area located in the coast border of West Sumatera facing the high seas and Indian Ocean that have long been a target from abroad fishing boats. Geographically, there are three areas located in strategic west coast of Sumatera such as Padang City, South Coast District, and Mentawai District. By the situation of opened-coast territorial geography, it is susceptible for illegal fishing of tuna by the local or abroad ships. The observed problems in this research are finding causing factors of illegal fishing in west coast of Sumatera to protect the waters environment under the local wisdom, how to implement the countermeasures of illegal fishing in the west coast of Sumatera. Moreover, there is a special attempt to find out the system and proper policy to cope with the potential happening often of illegal fishing that threatens the waters protection in west coast of Sumatera. The dominant method used in research is qualitative approach by implement two legal studies such as socio legal and normative legal study used in research on doctrines or useful principles of law. Moreover, characteristically this research categorized as the analytical descriptive.
