Abstract

This abstract discusses the position of individual property rights over the customary lands of the Moi Tribe in the West Papua region using an empirical research approach. The main objective of this research is to analyze how individual property rights to the customary lands of the Moi Tribe are recognized, implemented, and perceived in daily practice, as well as their impact on cultural and environmental sustainability. This study uses empirical research methods. Secondary data was obtained through a study of literature and official documents related to customary land laws and policies in West Papua. The results of the study show that the position of individual property rights over customary land of the Moi tribe faces complex dynamics between customary traditions and formal law. Formal legal recognition of individual property rights over customary land provides legal protection, but sometimes it also has the potential to create internal conflicts within indigenous peoples. Positive impacts are seen in economic empowerment and strengthening of the cultural identity of the Moi Tribe, but challenges such as intergenerational conflicts and development pressures also surface. This research concludes that the harmonious integration between customary law and formal law as well as the active participation of the Moi Tribe community in the management of customary lands is the key to ensuring the protection of sustainable individual property rights and cultural continuity. More inclusive and sustainable policy decisions need to be considered to address these challenges.

Abstract

This study aims to analyze the decision of the Supreme Court (MA) rejecting the cassation submitted by Nine AM Ltd. Based on two previous decisions, namely the DKI Jakarta High Court Decision Number 48/PDT/2014/PT.DKI dated 7 May 2014 and the West Jakarta District Court Decision Number 451/PDT.G/2013/PN JKT.BRT dated 20 June 2013, the Supreme Court considered that agreements that were only available in English were legally invalid because they violated Article 31 of the Language Law and violated the clauses as regulated in Article 1335 jo. Article 1337 of the Civil Code, then then is the use of a foreign language, namely English, legally invalid? Based on this problem, the conclusion is that:1. Article 31 of the Language Law regulates the obligation to use Indonesian, but there is no threat of sanctions. 2. Article 31 paragraph (2) of the Language Law also provides parties with the opportunity to write contracts in English. 3. Notarial Law Article 43 paragraph (3) which provides the opportunity for deeds to be made in a foreign language. 4. The lawful cause or cause of an agreement is the content of the agreement itself, not the language used.

Abstract

Complex economic growth in Indonesia is increasingly needed to support people's lives, one of the method is through credit to channel funds from banks to the people. The credit granthing as the main agreement s a high risk action, so that a guarantee is required as an additional agreement for the legal protection of creditor. The process of implementing credit agreements does not always in the good way. However, legislation does not yet cover everything regarding explicit legal protection for resolving disputes that arise for various part inside and outside the credit agreement who are disadvantaged by the execution of mortgage guarantees due to bad credit. This research aims to find out the form of legal protection for owners of mortgage objects who do not provide approval in the credit agreement and the legal remedies that can be taken by owners of mortgage objects if they are harmed by a credit agreement and legal efforts that can be taken. The research method used in this writing is normative juridical with a statutory and conceptual approach. Data sources come from primary data and secondary data using library study data collection techniques. The resulting research is that legal protection has not been regulated explicitly and evenly for various part inside and outside the credit agreement who are harmed if the debitor breaches their contract resulting in bad credit with the execution of the mortgage guarantee, and the cancellation of the auction has not been clearly regulated if this has occurred. the process of executing the mortgage guarantee auction. Legal efforts that can be taken by the owner of the collateral object who suffers loss from the execution of the auction of mortgage collateral is by filed a resistance with the district court.

Abstract

Many companies are currently trying to create games, both online and offline games because technology is developing very rapidly. These games also provide a purchase system in them. An example is a transaction to buy digital goods in a game using the gacha system. Gacha itself is a form of monetization strategy. The gacha system in this game includes various characters and certain items that players can obtain through this mechanism. This mechanism is carried out by players spinning or withdrawing gacha using game currency and then the results will be given randomly. So this research aims to analyze whether buying and selling in the game meets the buying and selling requirements in the Civil Code and to analyze how legal protection is when buyers make purchases using the in-game gacha system. Basically, a contract must be based on the agreement of the parties entering into the agreement and there is an element of uncertainty in the practice of buying and selling with this system. For these reasons, the author in this study chose the title "JUAL BELI BENDA VIRTUAL MELALUI SISTEM GACHA DALAM GAME ONLINEā€.

Abstract

The aim of writing this research is to determine the procedure for determining the criteria for similarities in the main elements of a well-known brand between Gudang Garam and Gudang Baru and to determine the impact of the Supreme Court Judge's considerations in deciding the dispute between the Gudang Garam and Gudang Baru brands in Supreme Court Decision Number 119PK/Pdt.Sus-HKI /2017. The research method used in this writing is normative legal research with primary legal materials, namely the Civil Code, Law Number 20 of 2016 concerning Marks and Geographical Indications; and Minister of Law and Human Rights Regulation Number 67 of 2016 concerning Trademark Registration, Minister of Law and Human Rights Regulation Number 12 of 2021 concerning Amendments to Ministerial Regulation Number 67 of 2016 concerning Mark Registration. This is motivated by Intellectual Property Rights (IPR) covering various elements, such as trademarks, geographical indications and product designs, which protect human creativity. In Indonesia, brands have developed since the 19th century, from producer identification to quality markers and psychological symbols. A registered trademark gives its owner exclusive rights and protects against infringement. Cases like PT. Gudang Garam vs. PR. Jaya Makmur shows the importance of brand protection and legal decisions in preventing misuse. The conclusion of this research is that the visual and conceptual similarities of the Gudang Garam and Gudang Baru brands mislead consumers. The Supreme Court's decision strengthens Gudang Garam's ownership of 79 registration numbers since 1979 in class 34. Strong evidence is needed for the plaintiff and improvements in the judge's consideration for a strong legal basis, especially when the trademark is being registered.

Abstract

Pursuant to established norms within customary law, the buying and selling of land constitutes a transfer of land rights that is both transparent and immediate. This transfer of right occurs simultaneously upon the buyer's payment following the principle of direct exchange or concrete transaction. The principle of land transactions shares similarities with general contractual agreements, necessitating adherence to Article 1320 of the Indonesian Civil Code. The sale and purchase of land under customary law are often witnessed solely by relatives, kin, and close neighbors, without the involvement of government officials. Claims may arise asserting that the process of transferring land rights was conducted in violation of regulations, particularly on the lack of official witnesses. This article employs a qualitative approach, involving the processing and analysis of data with a profound understanding of the researched issue. The normative juridical approach draws the prevailing legal provisions or employs the doctrinal legal method, and encompasses legal theories and expert opinions relevant to the discussed matter. The findings of this research underscore the prevailing agrarian law in Indonesia, which is rooted in customary law, as long as it aligns with national and state interests. Therefore, as long as the sale and purchase process is conducted genuinely, transparently, and immediately, and adheres to the principles of clarity and immediacy it is considered legally valid and is thereby irrevocable.Keywords: Land Purchase Agreement, The Principle of Transparency, The Principle of Immediacy. Penerapan Asas Transparan Dan Kedekatan Dalam Perjanjian Jual Beli Tanah (Studi Putusan Pengadilan Nomor 50/Pdt.G/2022/PN.Smn; 102/PDT/2022/PT.YYK, DAN 89/PDT.G/2022/ PN KLN) AbstrakBerdasarkan norma-norma yang berlaku dalam hukum adat, jual beli tanah merupakan peralihan hak atas tanah yang bersifat transparan dan segera. Perpindahan hak ini terjadi bersamaan dengan pembayaran pembeli dengan prinsip pertukaran langsung atau transaksi konkrit. Prinsip transaksi tanah mempunyai persamaan dengan perjanjian kontrak pada umumnya, sehingga harus dipatuhi Pasal 1320 KUHPerdata. Jual beli tanah menurut hukum adat seringkali hanya disaksikan oleh sanak saudara, kerabat, dan tetangga dekat, tanpa keterlibatan pejabat pemerintah. Dapat timbul tuntutan yang menyatakan bahwa proses peralihan hak atas tanah dilakukan dengan melanggar peraturan, khususnya karena tidak adanya saksi resmi. Artikel ini menggunakan pendekatan kualitatif, yang melibatkan pengolahan dan analisis data dengan pemahaman mendalam tentang masalah yang diteliti. Pendekatan yuridis normatif mengambil ketentuan hukum yang berlaku atau menggunakan metode hukum doktrinal, serta mencakup teori-teori hukum dan pendapat para ahli yang relevan dengan hal yang dibicarakan. Temuan penelitian ini menggaris bawahi hukum agraria yang berlaku di Indonesia, yang berakar pada hukum adat, sepanjang sejalan dengan kepentingan nasional dan negara. Oleh karena itu, sepanjang proses jual beli tersebut dilakukan dengan sungguh-sungguh, transparan, dan segera, serta berpegang pada asas kejelasan dan kesegeraan, maka dianggap sah secara hukum dan tidak dapat ditarik kembali.Kata Kunci: Perjanjian Jual Beli Tanah, Prinsip Transparansi, Prinsip Kedekatan.
