Abstract

Munculnya Ketidakpercayaan masyarakat terhadap Tuna Daksa sebagai Pelaku Tindak pidana Kekerasan Seksual (TPKS) menjadi fenomena yang terjadi belakangan ini. Sebagian Besar Masyarakat tidak mempercayai bahwasannya Tuna Daksa atau orang dengan keterbatasan Fisik mampu melakukan Kekerasan Seksual. Penelitian ini bertujuan untuk mengetahui faktor-faktor yang bisa merubah paradigma berfikir masyarakat terhadap pelaku tindak pidana yang memiliki keterbatasan fisik tetapi mampu melakukan tindak pidana layaknya orang normal pada umumnya, didukung fakta-fakta lapangan dan analisa penyebab fenomena terjadi berdasarkan pemberitaan yang beredar tentang Tindak Pidaan Kekerasan seksual yang dilakukan oleh tuna daksa. Penelitian ini menggunakan metode yuridis normatif dengan melalui studi kepustakaan yang dianalisis secara deskriptif. Kasus Tindak Pidana Kekerasan seksual yang terjadi belakangan ini adalah kasus-kasus kekerasan seksual yang dilakukan oleh seorang tuna daksa bernama I Wayan Agus Suartama atau yang disebut “Agus Buntung” yang memiliki keterbatasan fisik dengan keadaan fisik yang tidak memiliki kedua lengan tangan. Kasus Tindak Pidana kekerasan seksual yang dilakukan oleh tuna daksa adalah kasus pertama yang terjadi sehingga menyita perhatian masyarakat luas dan menimbulkan ketidakpercayaan publik. Kepercayaan publik terhadap kasus yang terjadi dapat dibangun jika masyarakat mengetahui asal muasal penyebab terjadinya tindak pidana kekerasan seksual tersebut tentunya disertai dengan fakta ilmiah ataupun logis sehingga keraguan masyarakat akan berkurang, tertutama jika kasus serupa terjadi dengan pelakunya adalah seorang tuna daksa.

Abstract

Restorative Justice is an alternative dispute resolution outside of criminal penalties, in other words, it is resolved through familial means and also aims to repair the relationship between the perpetrator and the victim. Recently, the application of restorative justice has been found in the field, which has become the main basis for resolving criminal cases of rape committed by police officers by filing an appeal in the appellate court, so that the police officer who is the perpetrator of the rape, named Bripda Fauzan (FA), who was previously subjected to the sanction of dishonorable dismissal (PTDH) in the Police Ethics Code Commission session, was not dismissed on the grounds that the rape case was considered resolved after the perpetrator married the victim. However, some time after the appeal decision, the perpetrator was reported again for allegedly neglecting his wife, who is the victim of the rape he married, which will be further examined in this research regarding the cause of Bripda Fauzan (FA) leaving his wife. This study aims to provide a real view of the application of restorative justice as the main basis for resolving rape cases, the method used in this journal is a normative juridical research method with literature studies and looking at empirical facts in the field through news circulating on the Internet media regarding rape cases by police members who are considered to have been completed after marrying the victim. The settlement of rape cases carried out by police members with restorative justice has tarnished the credibility of police institutions that do not seem to understand the fatality of sexual violence cases with the application of restorative justice in cases that have a major impact.
Fenomena Dehumanisasi dalam Kasus Pembunuhan dan Mutilasi Sadis Dilihat Dari Persfektif Psikologi Hukum: Studi Kasus Alvi Maulana Anes Sefta Asmita

Abstract

Murder and mutilation are extreme crimes that occur in everyday life, as the perpetrator not only takes the victim’s life but also mutilates the victim’s body. This study examines the phenomenon of dehumanization in a murder and mutilation case committed by Alvi Maulana against his girlfriend, Tiara Angelina Saraswati. Dehumanization is a phenomenon that leads to the loss of human qualities in an individual when committing a criminal act. In addition, social conditions, economic factors, and lifestyle demands also serve as supporting factors for acts of brutal murder and mutilation, which are further discussed in this study. This research specifically focuses on an analysis from the perspective of legal psychology, emphasizing the psychological factor of dehumanization in the acts of murder and sadistic mutilation committed by Alvi Maulana. The murder and mutilation were carried out by stabbing the victim, Tiara Angelina Saraswati, in the neck from behind. After the victim had died, Alvi Maulana consciously dismembered the victim’s body into several parts and disposed of them in multiple locations, including in front of the rented room occupied by the perpetrator and the victim, as well as in another location in the Pacet area, Mojokerto. The research method employed in this study is normative legal research with a case study approach, conducted through the analysis of media documents, interviews with law enforcement officials obtained from online news reports, and relevant references on legal psychology and dehumanization theory. The findings indicate that Alvi Maulana’s actions were influenced by multiple factors that led to dehumanization, including disturbed psychological conditions and external factors such as economic pressure and lifestyle demands from the victim, which became the primary causes of dehumanization or the loss of human values within an individual.
