Abstract

This research aims to understand the law of cash waqf from the perspective of the four madhhabs (Syafi'i, Hanafi, Maliki, and Hambali) and its implementation in Indonesia. The method used is literature research with a qualitative approach. The Shafi'i and Hambali schools tend to be strict in their views on cash waqf, with the majority of scholars stating that cash waqf is prohibited because the object of waqf must retain its physical form (ain) after use, such as dinars or dirhams. While there is a minority view from the more tolerant Shafi'i scholars, the Maliki school gives some leeway to cash waqf if it is based on the waqf of movable objects. On the other hand, the Hanafi and Maliki schools allow cash waqf based on istihsan bi al-'urf, as cash waqf has become an accepted custom in both schools. Based on these four madhhabs, it can be concluded that there are two views regarding the law of cash waqf. The Shafi;i and Hambali schools reject cash waqf because they argue that waqf must be in the form of objects that are fixed and not used up in order to maintain the permanence of waqf assets, while the Maliki and Hanafi schools allow cash waqf based on the view that waqf assets are not only seen from movable and immovable objects but are more complex than that that waqf assets such as cash waqf must focus on the aspects of the usefulness  the waqf object.

Abstract

Introduction to The Problem: Indonesia, the world's largest Muslim-majority country, was named the most generous country globally by the Charities Aid Foundation (CAF) for the seventh consecutive year based on the Word Giving Index 2024. The country has several Islamic public finance instruments, including zakat, infaq, sadaqah and waqf. In 2021, the Directorate of Zakat and Waqf Empowerment noted that the potential of national cash waqf reached 180 trillion rupiah. However, this huge potential has not been optimally managed, while the welfare of the Muslim community and access to financing for MSMEs remain a challenge.Purpose/Objective Study: This research aims to identify the potential of Cash Waqf Linked Sukuk (CWLS) for MSMEs empowerment.Design/Methodology/Approach: This research used a qualitative approach to provide a detailed description in the discussion section, making it easier for readers to understand. The data used is secondary data obtained from previous research results or journals that have been published via the internet, and statistical data sourced from OJK.Findings: This study finds that CWLS has a great opportunity in Indonesia. The legality of cash waqf supports this stated in the law as well as cooperation between the Indonesian Waqf Board, Islamic financial institutions, Bank Indonesia, the Ministry of Finance, and the Ministry of Religious Affairs. Good management can maximize the potential of CWLS for MSME empowerment. Recommendations for further research include the development of a CWLS-based MSME empowerment model that utilizes big data and artificial intelligence, enabling in-depth analysis to understand the specific needs of MSMEs and optimize fund allocation.Research Type: Research Article

Abstract

Purpose/Objective Study: This study aims to analyze publication trends on Islamic Social Enterprise (ISE) using bibliometric analysis.Design/Methodology/Approach: The method used is a literature review with a bibliometric analysis approach using R Studio software. In this study, there are six subthemes discussed, namely trends in the number of publications, number of citations, countries, journal publications, research collaborations, researcher affiliations, and future research topics.Findings: The analysis showed that an average of 4.73% of papers were published annually; the number of citations from 1979-2004 was only about 0.2%, while from 2005-2023 it reached 2%. Malaysia and Indonesia are the countries that conduct the most research on ISE. ISE journal publications are dominated by several international journals, and research collaborations and researcher affiliations are dominated by universities from both countries. Future ISE research topics are still limited, with potential keywords such as Social Enterprise, Islamic Social Enterprise, and Small and Medium Enterprises.Type Paper: Article review

Abstract

Productive waqf has great potential to improve the welfare of the ummah, but its management remains varied and has not yet been fully optimized. This study aims to describe the model of productive waqf management in the agricultural sector based on maqashid syariah indicators at Masjid Darussalam Kopang. This study used a descriptive qualitative method with research subjects comprising waqf administrators, cultivating farmers, and the local community. Primary data were obtained through interviews, while secondary data were collected through a literature review and then analyzed using the Miles, Huberman, and Saldana model. The results showed that productive waqf management had implemented maqashid syariah comprehensively through the systems approach developed by Jasser Auda. All system features, namely cognitive nature, wholeness, openness, interrelated hierarchy, multidimensionality, and purposefulness, were actualized in waqf management practices. Waqf is no longer understood statically, but rather as a dynamic instrument managed productively, transparently, and accountably. This management was able to create an integrated ecosystem across economic, social, and spiritual aspects, and to generate transformative impacts, such as the transformation of mustahik into muzakki, improved food security, expanded access to education, and broader social benefits. The conclusion of this study emphasizes that productive waqf functions as an empowerment instrument based on human development that is capable of improving community welfare while also serving as a model for the implementation of maqashid syariah that is adaptive, inclusive, and sustainable in the management of Islamic social finance assets.
