Abstract

Abstract. E-commerce telah menjadi salah satu landasan bisnis modern, mengubah cara transaksi antara pebisnis dan konsumen terjadi di seluruh platform digital. Penelitian ini bertujuan untuk mengetahui makna e-commerce, model bisnis yang ada, dan prinsip-prinsip fiqih Muamalah terkait perdagangan online. E-commerce mencakup berbagai model seperti B2B, B2C, C2C, dan C2B, yang masing-masing memiliki karakteristik, manfaat, dan tantangan tersendiri. Selain itu, penelitian ini juga menyoroti pentingnya kejujuran, transparansi, dan keadilan dalam e-commerce sesuai dengan prinsip-prinsip Syariah. Meskipun e-commerce menawarkan banyak manfaat, seperti biaya operasional yang lebih rendah dan akses pasar yang lebih besar, tantangan seperti keamanan data, peraturan yang tidak memadai, dan persaingan yang ketat masih menjadi perhatian utama. Memahami dinamika ini dapat membantu perusahaan mengoptimalkan strategi e-commerce mereka dan mencapai kesuksesan yang berkelanjutan. Penelitian ini diharapkan dapat memberikan wawasan berharga bagi para manajer dan pemangku kepentingan dalam mengatasi tantangan dan memanfaatkan peluang di era digital.

Abstract

This research aims to examine the suitability of the concept of salam contract in Islamic law with the pre-order buying and selling system in online shops, and analyze its implementation in creating fair and Sharia-compliant transactions. The salam contract, as a form of contract in muamalah fiqh, allows for advance payment for goods that will be delivered at a later date. This characteristic has relevance to the pre-order system that is widely used in digital transactions today. This research uses the library research method. Data were collected through a literature study of primary and secondary sources, such as fiqh books, scientific journals, and relevant papers. The analysis is conducted to identify the similarities in principle between salam and pre-order contracts, and evaluate the potential problems that may arise in their application. The results show that the salam contract can be used as a reference in the pre-order system, as long as it fulfills the sharia requirements, such as full payment in advance, clarity of goods specifications, and certainty of delivery time. The application of the salam contract principle to pre-order sales in online shops not only strengthens the sharia legal aspects, but also increases the trust between sellers and buyers. This research confirms that the salam contract is a flexible and relevant solution in modern sharia-based economic transactions.

Abstract

The halal industry is an inevitability of the development of a business where there is demand (demand), then there is someone who provides (supply). And the prospects are very promising with increasing growth from time to time. Even though it is labeled halal which is synonymous with religious symbols, it is not a barrier for consumers of all religions and nations to enjoy it. Because halal in its development is a symbol of guaranteeing cleanliness, safety and product quality for the entire production chain. Modern global society sees the substance as not a skin. The Halal industry is not just a business machine in general, which is materialistic in nature and profit-oriented, but there are messages or values ??of Islamic teachings originating from the Qur'an and Hadith that must be upheld. Therefore, in his journey must be in accordance with the provisions of the Shari'a. Islamic economists, such as Yusuf Qardhawi, Syed Nawab Heidar Naqvi, Adiwarman Karim and Mustaq Ahmad gave their opinions on the ideal Halal Industry. They said that the essence of Islamic economics at least has the character of monotheism (uluhiyyah-rububiyyah), humanity (insaaniyah), ethical norms (akhlaqiyyah), balance (wasathiyyah), free will (ikhtiyar) and responsibility (mas’uliyyah). If some of these become part of the business of Muslims, such as the halal industry, they will get material success (dhahir) and spiritual happiness (batin).

Abstract

This study aims to explore how fiqh principles are applied in the operations of Islamic financial institutions in Indonesia. Fiqh principles, which form the basis of Islamic law, serve as guidelines for financial contracts and transactions, ensuring they comply with Islamic law and Islamic values. The qualitative method used focuses on literature review and analysis of the implementation of fiqh principles in contracts such as mudharabah, musyarakah, murabahah, and other contracts. The findings of this study indicate that the application of fiqh principles in Islamic financial institutions not only improves product halal certification and transaction transparency but also strengthens customer trust and institutional stability through Sharia-compliant risk management. Successful strategy implementation includes maintaining internal regulations, staff training, consultation with fiqh experts, and ongoing supervision to maintain operational integrity. Thus, Islamic financial institutions in Indonesia can grow sustainably and provide broad benefits to society in accordance with Sharia principles.
