Abstract

The development of digital technology has driven the growth of digital-based businesses in Indonesia, creating new challenges in legal aspects. Digital businesses cover various sectors, such as e-commerce, financial technology (fintech), and other digital platform-based services. Along with these developments, various legal issues have emerged, including consumer protection, personal data protection, electronic transactions, and dispute resolution in digital businesses. Therefore, a comprehensive legal review is needed to understand the applicable regulations and mechanisms for handling digital business legal cases in Indonesia. This study aims to analyze the legal framework governing digital businesses in Indonesia, examine the dispute resolution mechanisms in digital businesses, and identify challenges in implementing existing regulations. This study uses a normative legal research method, which focuses on the analysis of laws and regulations, legal doctrines, and relevant literature. The approaches used include a statute approach to examine regulations related to digital businesses, as well as a conceptual approach to understand the legal theory that supports legal protection and certainty in this sector. The analysis results are expected to contribute to more effective digital business development regulations and encourage the creation of a legal system that is adaptive to technological developments. Additionally, this study aims to provide recommendations for the government, regulators, and business actors in increasing legal certainty and protection for parties involved in digital business in Indonesia. Thus, it is expected that digital business legal regulations can further support a safe, transparent, and sustainable business ecosystem in the digital era.

Abstract

The legal landscape surrounding online legal consultations in Indonesia is complex. This research aims to analyze the legal certainty surrounding the regulation of online legal consults by advocates in Indonesia, contributing significantly to the understanding of the existing legal framework governing these services. Thematic analysis was employed to identify key themes and patterns related to the legal and ethical challenges faced in practice. The findings provide guidance for policymakers on the need for clearer regulations, which could enhance standards and protections for both advocates and clients. Increasing advocates' knowledge about the regulations and ethics of online consultations, developing secure platforms, and clearly promoting legal services to the public are essential steps to create trust and enhance public participation in utilizing these services, while also laying the groundwork for future studies on related topics.

Abstract

The position and role of advocates are crucial in realizing an integrated criminal justice system in Indonesia. Advocates serve as a bridge for ensuring access to justice and protecting the legal rights of individuals, but their role often faces challenges due to a lack of effective coordination among law enforcement agencies. This research aims to analyze the critical role of advocates in improving the criminal justice system’s responsiveness and coherence. Using a normative legal research method, the study examines relevant regulations, particularly Law No. 18 of 2003 on Advocates, and explores their practical application through legal literature and secondary data analysis. The findings highlight that advocates play an essential role in fostering coordination among key elements of the justice system, including the police, prosecutor’s office, and judiciary. However, the study identifies significant challenges in optimizing their contributions, such as regulatory gaps and insufficient collaboration frameworks. Strengthening the regulation and coordination mechanisms for advocates is imperative for achieving a more integrated and effective criminal justice system. In conclusion, enhancing the advocate’s role as a law enforcer will contribute to a fairer and more efficient justice system in Indonesia.
