Abstract

AbstrakPerguruan Tinggi Negeri Berbadan Hukum (PTNBH) adalah konsep perguruan tinggi baru di Indonesia. Dengan status badan hukum, PTNBH dikatakan sebagai subjek hukum yang cakap dalam menjalankan tugas dan tanggungjawabnya, sehingga tidak menutup kemungkinan akan terlibat dalam sengketa. Peneliti menyadari potensi sengketa yang akan dihadapi PTNBH, salah satunya adalah sengketa konstruksi. Sebab, salah satu aspek kemajuan perguruan tinggi adalah sarana. Arbitrase merupakan pilihan penyelesaian sengketa perdata yang didasarkan pada perjanjian arbitrase yang dibuat secara tertulis oleh para pihak yang bersengketa. Berdasarkan temuan peneliti yang dilakukan dengan metode normatif, PTNBH dapat terlibat dan mengikatkan diri terhadap sebuah perjanjian arbitrase, ini dimungkinkan karena status PTNBH yang merupakan badan hukum secara mandiri sehingga dapat melakukan perbuatan hukum secara leluasa sebagai subjek hukum. Sebagai pilihan penyelesaian sengketa, arbitrase memiliki beragam keunggulan, mulai dari waktu penyelesaian sengketa yang singkat, biaya yang terukur, pelaksanaan penyelesaian sengketa secara tertutup dan keunggulan lain dibanding penyelesaian sengketa di pengadilan negeri.Kata Kunci: Arbitrase, Sengketa, Perguruan Tinggi Negeri Berbadan HukumAbstractLegal Entity-State University (PTNBH) is a new university concept in Indonesia. With a legal entity status, PTNBH is said to be a legal subject capable of carrying out its duties and responsibilities, so it does not rule out the possibility of being involved in a dispute. Researchers are aware of the potential disputes which PTNBH will face, one of which is a Construction dispute. Considering, one of the aspects of the advancement of a university is facilities. Arbitration is a civil dispute resolution option that is based on an arbitration agreement made in writing by the parties to the dispute. Based on a normative method research which was found by the Author, PTNBH may be involved and bind itself to an arbitration agreement, this is possible because of PTNBH's status as an independent legal entity so that it may carry out legal actions freely as a legal subject. As a dispute resolution option, arbitration has various advantages, starting from the short duration of dispute settlement, measurable costs, implementation of closed dispute resolution and other advantages compared to dispute resolution in a district court.Keywords: Arbitration, Dispute, Legal Entity-State University

Abstract

This study investigates the persistently low compliance of Micro, Small, and Medium Enterprises (MSMEs) with halal certification, despite its critical role in safeguarding the five essential objectives of Islamic law (ad-dharuriyyah al-khamsah): religion (dīn), life (nafs), intellect (‘aql), lineage (nasl), and property (māl). Employing a qualitative research design, this study utilizes a descriptive-analytical approach supported by thematic content analysis. Data were collected through a systematic literature review, including primary Islamic sources (Qur’an, Hadis, and classical jurisprudence) and relevant secondary literature (peer-reviewed journals, regulations, and government reports). The findings were categorized based on the maqāṣid al-shari'ah framework to ensure a structured and normative analysis. The results reveal that halal certification serves as a multidimensional protection mechanism, with the preservation of life (ḥifẓ al-nafs) identified as the most urgent priority. This emphasis stems from product consumption's direct psychological and ethical implications on human well-being. By elevating ḥifẓ al-nafs above traditional priorities such as ḥifẓ al-dīn, the study offers a contextual reinterpretation aligned with contemporary public health and ethical standards. Moreover, this research fills a notable gap in the literature by explicitly linking halal certification to the comprehensive structure of ad-dharuriyyah al-khamsah, a dimension often overlooked in previous studies. Policy recommendations include financial incentives, awareness campaigns, streamlined regulations, and stakeholder collaboration, highlighting the dual role of halal certification as both a religious obligation and a vehicle for public welfare.

Abstract

This Community Service Program aimed to introduce the concept of Alternative Dispute Resolution (ADR), particularly arbitration, as a preventive approach in managing business dispute risks within micro, small, and medium-scale culinary enterprises. Culinary-based MSMEs generally rely on trust and informal communication in their commercial transactions, making them vulnerable to conflicts arising from differences in interpretation, delayed payments, price changes, or contract breaches. Through this program, participants were provided with knowledge of the legal position of arbitration as a dispute-resolution forum outside the state court system, the final and binding nature of arbitral awards, and the importance of incorporating simple arbitration clauses into business agreements as a tool for dispute prevention. The activity was implemented using a combination of lecture, discussion, and question-and-answer methods. The results show that participants demonstrated a high level of interest due to limited access to information related to non-litigation dispute resolution mechanisms. Participants also acknowledged that inserting simple arbitration clauses—even in order forms commonly used in day-to-day operations—constitutes a realistic approach. This program has encouraged an increased awareness of the need for more structured contractual practices as part of improving business governance among MSMEs. It is expected that this knowledge could stimulate MSMEs to develop transactional systems that not only rely on trust but are also equipped with adequate preventive instruments, thereby strengthening the stability, security, and competitiveness of their business practices.

Abstract

Private Higher Education Institutions (PTS) in Indonesia are private legal entities with full legal capacity to enter into agreements with third parties, acquire rights, assume obligations, and engage in contractual relations. In its various academic and non-academic activities supporting the Tri Dharma, civil disputes are inevitable. Litigation before the court is still commonly used, yet the judicial process is time-consuming, costly, formalistic, and publicly open to scrutiny—potentially harming institutional reputation. Arbitration emerges as an alternative dispute resolution mechanism that is normatively recognized within Indonesian law, produces final and binding awards, and provides a dispute settlement model that is faster, confidential, flexible, and more compatible with contemporary business needs. This article examines the strategic use of arbitration by PTS as an instrument of good university governance and legal risk management. A clear arbitration clause prevents forum shopping and jurisdictional conflicts before disputes escalate further. Consequently, arbitration should not merely be treated as an optional clause within contracts, but as a deliberate institutional policy to ensure legal certainty, efficiency, and the preservation of institutional credibility
