Abstract

This study analyzes the responsibility of local governments towards victims of the Trans Metro Deli Bus accident using the maslahah mursalah approach. This principle, as part of Islamic law, provides flexibility in making public policies that are oriented towards the public interest and public welfare. Accident data in Medan shows a high number of incidents involving public transportation, demanding strategic steps from the government. This study explores the role of the Medan City Transportation Agency and the Governor of North Sumatra in providing safe infrastructure, strict regulations, and comprehensive victim handling. The results of the study indicate that the implementation of maslahah mursalah can guide social justice-based policies, such as emergency evacuation, medical services, and fair compensation. This policy must be inclusive, transparent, and meet the basic needs of the community (dharuriyah) without contradicting the qath'i nash. With this approach, public policy not only addresses the direct impacts of accidents but also encourages the development of a safer and more sustainable transportation system. Keywords: Maslahah Mursalah, Legal Responsibility, Local Government, Transportation Accidents, Trans Metro Deli
