Abstract

Trademarks are used by brand owners based on trademark rights obtained according to each country’s regulations. Trademark rights are not an absolute monopoly and have a time limit. These rights can only be used by the owner or authorized parties. Indonesia applies the first-to-file system to ensure legal certainty for brand owners. However, many businesses are unaware of the importance of trademark registration, leading to frequent violations of both registered and unregistered trademarks. In contrast, the United States follows the use in commerce system, which provides protection even for unregistered trademarks. Trademark infringement cases often arise when a product goes viral, and other businesses use similar branding without authorization, leading to legal disputes and economic losses. Legal awareness regarding Intellectual Property Rights remains low in Indonesia. Trademark registration is crucial for businesses, especially MSMEs, to gain legal protection and exclusive rights under Law No. 20 of 2016 concerning Trademarks. Community Service activities related to legal counseling on MSME product brand ownership in Rattan Tourism Village, Trangsan, Gatak, Sukoharjo, aim to enhance legal knowledge and awareness among MSME business actors.

Abstract

Desa Trangsan di Kecamatan Gatak Kabupaten Sukoharjo dikenal sebagai pusat industri kerajinan rotan, memiliki potensi ekonomi yang besar melalui usaha mikro, kecil, dan menengah (UMKM). Terdapat beberapa tantangan terkait legalitas usaha, pemahaman mengenai hukum bisnis, dan perlindungan hak pelaku usaha yang menjadi kendala utama bagi pengembangan UMKM di desa Trangsan. Untuk mengatasi tantangan ini, kegiatan pengabdian masyarakat bertujuan memberikan pemahaman kepada pelaku UMKM tentang bagaimana hukum bisnis mendukung keberlangsungan usaha mereka. Metode yang digunakan mencakup sosialisasi, diskusi interaktif, dan pendampingan teknis mengenai aspek legalitas, seperti pendaftaran usaha lewat OSS, kontrak bisnis yang adil, perlindungan merek, dan akses pembiayaan formal. Hasil dari kegiatan ini menunjukkan peningkatan pemahaman peserta tentang pentingnya hukum dalam bisnis, yang mendorong banyak pelaku UMKM untuk segera melengkapi dokumen legalitas, menyusun strategi pemasaran produk, dan memisahkan keuangan bisnis dari keuangan pribadi. Selain itu, pelaku UKM berharap adanya pendampingan dan pelatihan lebih lanjut mengenai pemasaran online. UU Nomor 11 Tahun 2020 tentang Cipta Kerja dan Peraturan Pemerintah Nomor 7 Tahun 2021 tentang Pembinaan, Perlindungan, dan Penguatan Koperasi Kecil dan Usaha dijadikan dasar. Konsep mekanisme perlindungan hukum yang adil diperlukan untuk mengatasi ketimpangan dalam sistem ekonomi pasar bebas, yang menciptakan kesenjangan antara pengusaha besar dengan UMKM. Indonesia memiliki kontribusi sebesar 60% dari UMKM, sehingga sektor ini memainkan peran penting dalam ekonomi nasional dan meningkatkan devisa negara. Oleh karena itu, perlu dilakukan kajian tentang perkembangan UMKM untuk mendukung pertumbuhan ekonomi di Indonesia serta perlindungan UMKM dengan pendekatan keadilan ekonomi. Kegiatan pengabdian masyarakat ini bertujuan untuk memperkuat kesadaran pelaku UMKM akan pentingnya kepatuhan hukum bisnis demi menciptakan ekosistem usaha yang lebih kompetitif, berkelanjutan, dan terlindungi dari risiko hukum. Program ini diharapkan menjadi model pengembangan bagi desa-desa lain yang memiliki potensi UMKM yang serupa. Kata Kunci: Hukum Bisnis, UMKM, Legalitas Usaha, Pengabdian Masyarakat.

Abstract

Peran Hukum Bisnis dalam mendorong kewirausahaan Bisnis  Usaha Mikro, Kecil, dan Menengah (UMKM) memainkan peran penting dalam perekonomian Indonesia. Namun, banyak UMKM yang menghadapi berbagai tantangan, seperti kurangnya pengetahuan tentang kewirausahaan dan akses terhadap informasi bisnis. Adanya legalitas yang jelas UMKM dapat lebih dipercaya oleh konsumen dan memiliki perlindungan hukum. Sementara itu proses strategi digitalisasi pemasaran yang baik menjadi salah satu kunci untuk memperluas pasar dan meningkatkan daya saing UMKM. Jurnal ini membahas peran hukum bisnis dalam mendukung kewirausahaan termasuk regulasi yang ada, tantangan yang dihadapi, dan rekomendasi untuk pengembangan perekonomian negara lebih lanjut.

Abstract

This study aims to analyze the judge's considerations and legal consequences of the cancellation of registered trademarks and determine the party who has the right to be the actual holder of trademark rights to the issuance of intellectual property rights trademarks and product logos. Law Number 20 of 2016 concerning Trademarks and Geographical Indications states that registered trademark owners can file a lawsuit against other parties who without the right to use the Trademark that has similarities in principle or all for similar goods and/or services by filing a lawsuit for compensation and/or termination of acts related to the use of the Trademark. With this article, it can benefit registered trademark owners to be able to file a lawsuit against parties who try to piggyback on their brands to make profits. The problem is that the use of trademarks that contain similarities is basically proven to violate the provisions of Article 21 paragraph 1 of Law Number 20 of 2016 concerning Trademarks and Geographical Indications, showing that trademark law enforcement in Indonesia has not been carried out effectively that the theory of legal effectiveness according to Soekanto which states that the effectiveness of law enforcement can be influenced by certain factors, including legal factors, law enforcement factors, community factors, and cultural factors. In conclusion, the Judge has an important role in deciding the Trademark dispute case because it is to interpret the law so that it is possible for the judge to find legal value and even create a legal rule as contained in case law. These reasons or arguments are intended as the judge's accountability rather than his decision to the community, so that therefore they have objective value.

Abstract

This research aims to analyze the role and authority of the National Collective Management Institute (LMKN) in regulating and enforcing licensing and royalty distribution between singers and songwriters. In addition, this study also examines a futuristic interpretation that can be applied in the licensing system between singers and songwriters to strengthen the enforcement of royalty rights in the future in accordance with Article 34 of Law Number 28 of 2014 on Copyright, which states that in cases where a creation is designed by one person and realized and executed by another under the leadership and supervision of the designer, the designer is considered the creator. The problem is the legal uncertainty felt by performers regarding the use of copyrighted works in concerts or performances without direct permission from the song creators. The exception for direct permission is for those who request that the use of their works in commercial performances does not require direct permission from the song creators, as long as royalties are still paid. The obligation to pay royalties must contain legal certainty that the obligation to pay royalties becomes the responsibility of the event organizer, unless there is a different agreement between the parties involved, as royalty payments are a civil matter according to the content of Article 1320 of the Civil Code. In conclusion, the potential for abuse of power and arbitrariness due to the lack of a clear control mechanism over LMKN creates the potential for abuse of authority in the management of royalties, even arbitrariness. The duality of authority with Collective Management Institutions (LMK). Government Regulation no. 56 of 2021 concerning the Management of Copyright Royalties for Songs and/or Music based on Law No. 28 of 2014 concerning Copyright grants LMKN the authority to collect and distribute royalties. This authority is the same as that of LMK. This means that one authority is granted to two different institutions.
