Abstract

Penelitian ini bertujuan untuk mengetahui dan mengkaji mengenai pengaturan ambang batas pencalonan Presiden dan Wakil Presiden dalam Pemilihan Umum dan untuk mengetahui dan mengkaji mengenai urgensi penentuan ambang batas sebagai syarat pengajuan Calon Presiden dan Wakil Presiden. Metode penelitian hukum yang digunakan dalam penelitian ini adalah tipe penelitian hukum yuridis normatif, yaitu mengkaji peraturan perundang-undangan yang berlaku dan pembahasan dalam penelitian ini bersifat normatif. Pembahasan yang dimaksud ditujukan untuk menelaah struktur-struktur rasional, sistem-sistem hukum yang berlaku, hal ini dilakukan untuk pengolahan ilmiah terhadap bahan-bahan normatif hukum, sehingga pembentukan hukum akan semakin profesional. Hasil penelitian ini mengungkapkan pengaturan ambang batas persyaratan pencalonan Presiden dan Wakil Presiden tidak secara tegas diatur dalam Pasal 6A ayat (2) UUD 1945, hanya diusulkan oleh Partai Politik atau gabungan Partai Politik, namun dalam Pasal 222 UU Pemilu mengatur Pasangan Calon diusulkan oleh Partai Politik atau Gabungan Partai Politik yang memperoleh Kursi Paling sedikit 20% dari jumlah kursi di DPR, atau memperoleh 25% dari suara sah. Urgensi penentuan ambang batas syarat pengajuan pasangan Calon Presidenan dan Wakil Presiden agar mendapat dukungan dari Partai Politik Peserta Pemilu. Tetapi selain itu diharapkan perlu penyempurnaan Undang-Undang Pemilihan Umum mempertegas bahwa setiap Partai Politik Peserta Pemilu yang mendapatkan kursi di DPR dapat mencalonkan Pasangan Presiden dan Wakil Presiden. Sedangkan penentuan ambang Batas dihapuskan dan disesuaikam dengan bunyi Pasal 6A ayat (2) UUD 1945, Pasangan Calon diusulkan oleh Partai politik, atau Gabungan Partai Politik tanpa penentuan ambang batas.

Abstract

This study aims to determine and examine the meaning contained in Article 18 paragraph (4) of the 1945 Constitution of the Republic of Indonesia which states that the Governor, Regent and Mayor respectively as Head of the Provincial, Regency and City Regional Government are elected democratically. The approach method used in this study is normative juridical which is used to discuss this main problem, namely the legislative approach and the conceptual approach. The results of this study prove the birth of the word democratic in Article 18 paragraph (4) of the Constitution when the 1945 Constitution was amended in the MPR General Session in 2000, where there were 2 (two) different opinions regarding the method of electing regional heads, one requiring direct elections by the people or the other being elected by the DPRD. The agreement on the democratic formulation for regional elections was achieved with the intention of being flexible. So that the Lawmakers can formulate the election system desired by the community in the election of regional heads so that the community has a choice by the DPRD or direct election by the people. This is also intended as a form of constitutional respect for the diversity of customs and cultures of communities between different regions. As regulated in Article 18B of the 1945 Constitution of the Republic of Indonesia which recognizes regional government units that are special and special and recognition of the unity of customary law communities. This is supported by the Constitutional Court Decision Number 072-073/PUUII/2004 and the Constitutional Court Decision Number 97/PUU-XI/2013, which explains the background of the thinking behind the formulation of Article 18 paragraph (4) of the 1945 Constitution at that time, the regional head election system that will be implemented is adjusted to the development of society and conditions in each region concerned. The goal is to adjust to the dynamics of national development to determine the democratic system desired by the people.

Abstract

General elections are the main pillars of Indonesian democracy as stipulated in Article 27 of the 1945 Constitution of the Republic of Indonesia and Law Number 7 of 2017 concerning General Elections. The younger generation, which makes up about 55% of the total electorate, has a strategic role in determining the political direction of the nation. However, the phenomenon of political apathy and white groups (golput) among the younger generation shows a low awareness of their constitutional rights and obligations. This research aims to analyze efforts to increase the political awareness of the younger generation through political education and legal socialization. The method used is counseling and mentoring activities for students of SMK Negeri 8 Information and Communication Technology Jayapura on July 25, 2025. The results of the study show that systematic and comprehensive political education is able to increase the understanding of the younger generation about the importance of participation in elections, the right to vote as citizens, as well as the dangers of politicization and irrational mobilization. In conclusion, increasing the political awareness of the younger generation requires synergy between election organizers, the government, and educational institutions to form rational, critical, and actively participating voters in the democratic process.

Abstract

Political disinformation on social media has emerged as a major threat to electoral integrity due to its rapid, large-scale dissemination driven by platform algorithms. This study analyzes the patterns of political disinformation and evaluates the weaknesses of Indonesia’s electoral regulatory framework in addressing digital-era challenges. A Systematic Literature Review was conducted under the PRISMA protocol, selecting 14 peer-reviewed articles published between 2014 and 2024 and synthesizing them thematically. The findings reveal that political disinformation spreads through echo chambers, coordinated buzzer networks, AI-generated manipulative content, and interpersonal distribution in encrypted private channels. At the same time, Indonesia’s electoral regulations show structural limitations, including the absence of a clear legal definition of political disinformation, insufficient digital monitoring authority for election supervisors, lack of rules on political microtargeting and voter data protection, and limited cooperation between regulators and global digital platforms. The study concludes that comprehensive reform is required, involving legal definitional updates, enhanced institutional technical capacity, increased transparency in digital political advertising, and the adoption of multilevel governance frameworks to manage cross-border platform dynamics. These insights provide a foundation for policymakers to develop an electoral regulatory system that is more responsive and resilient in the social media era
