Abstract

The purpose of this scientific research article is to analyze the normative juridical review of illegal logging crimes by the Dittipidter Bareskrim Polri, to examine the elements contained in illegal logging crimes in cases of forestry resource exploitation, and to find out the efforts that can be made by the Dittipidter Bareskrim Polri as a follow-up to handling criminal acts of illegal logging in order to minimize the occurrence of cases of forestry resource exploitation. In this research, classical law enforcement theory is used. The research method used is qualitative with a normative juridical approach. The results of the research show that the normative juridical review of illegal logging criminal acts by the National Police's Criminal Investigation Directorate refers to the P3H Law no. 18 of 2013. The elements contained in the criminal act of illegal logging in cases of exploitation of forestry resources, namely increasing population, changing the function of forestry areas to other land, changing the function of mangrove forests into ponds, lack of understanding of land ownership and use of natural resources, non-synchronization of PP No. 21 of 1970 regarding the forest exploitation system, availability of wood raw materials, environmental pollution around industry and agriculture in forests, population transmigration, lack of coordination between parties, and weak law enforcement. Efforts that can be carried out by the Dittipidter Bareskrim Polri include restructuring the wood processing industry, cooperative management of law enforcement regarding the exploitation of forestry resources, operations to secure forest areas on an ongoing basis blended learning, wildlife inter-regional enforcement, identifying building blocks or strategies for a holistic approach around emerging technologies in policing, the wildlife trafficking cybercrime program, dan training on development of suspects profiles (wildlife crime).

Abstract

Penelitian ini bertujuan membandingkan kebijakan pengungsi di Indonesia dan Turki serta dampaknya terhadap ketahanan nasional dalam konteks krisis pengungsi global. Fokus penelitian meliputi implementasi kebijakan, dampak sosial-ekonomi, dan implikasi keamanan. Turki, sebagai tuan rumah pengungsi terbesar akibat konflik Suriah, dan Indonesia, sebagai negara transit bagi pengungsi Rohingya, menghadirkan studi kasus yang kontras untuk memahami pendekatan dan dampaknya terhadap ketahanan nasional. Penelitian ini menggunakan metode Systematic Literature Review untuk mengkaji kebijakan pengungsi di kedua negara. Pendekatan ini melibatkan analisis kerangka kebijakan, dimensi sosial-ekonomi, dan keamanan, serta dampak pandemi COVID-19 terhadap akses layanan dasar dan ketegangan social. Hasil penelitian menunjukkan bahwa kebijakan pengungsi berpengaruh signifikan terhadap ketahanan nasional, terutama pada aspek keamanan, stabilitas sosial, dan ekonomi. Turki, dengan pendekatan perlindungan sementara, menghadapi tantangan besar terkait sumber daya dan kohesi sosial. Sebaliknya, Indonesia menghadapi keterbatasan hukum dan sumber daya sebagai negara transit. Penelitian ini menekankan pentingnya kebijakan pengungsi yang adaptif dan berkelanjutan untuk menghadapi tantangan krisis global.

Abstract

Police discretion is central to community policing, influencing how law enforcement officers interpret and apply the law in everyday interactions. In Harare Metropolitan Province, police discretion is particularly visible in informal market areas and at urban roadblocks, where enforcement practices often appear inconsistent. Although statutory frameworks guide police authority, a gap remains between legal expectations and the practical application of discretion, contributing to community mistrust and weakened police legitimacy. This research examines: (1) the nature of discretionary policing in Harare, (2) the institutional and socio-political factors influencing discretionary decision-making, and (3) the effects of discretionary practices on police–community relations. Understanding these dynamics is important for strengthening democratic policing and promoting public trust. A qualitative research design was adopted, utilizing secondary data from academic literature, legal documents, policy reports, and recent empirical studies relevant to policing in Zimbabwe. Findings show that police discretion is shaped by resource limitations, weak oversight mechanisms, and socio-political influences. In areas such as Mbare Musika, Machipisa, and major commuter routes within Harare Metropolitan Province, police discretionary decisions frequently lack consistency and transparency, leading to perceptions of selective law enforcement and diminished community cooperation. Discretionary policing practices have significant implications for public trust and the effectiveness of community policing. Strengthening accountability systems, improving law enforcement officers' training, and enhancing collaborative police–community engagement are recommended to restore legitimacy and support safer community environments.
