Abstract

ABSTRAK Sertipikat sebagai surat bukti tanda hak, diterbitkan untuk kepentingan pemegang hak yang bersangkutan, sesuai dengan data fisik yang ada dalam surat ukur dan data yuridis yang telah di daftar dalam buku tanah. Di indonesia pendaftaran hak atas tanah dengan sistem negatif, yang artinya sertipikat dapat dibatalkan, karena suatu sebab yang membatalkan (Misalnya dalam prosedur yag tidak memenuhi syarat). Metode yang digunakan dalam penelitian ini adalah metode normatif. Penelitian hukum normatif adalah penelitian hukum terhadap data sekunder berupa penelitian kepustakaan (library research) yang dilakukan dengan cara meneliti bahan kepustakaan yang berupa data primer, sekunder, dan tersier. Berdasarkan hasil penelitian ditemukan bahwa Dengan adanya putusan PTUN Nomor 12/G/PTUN-PTK/2004 maka dapat diketahui bahwa majelis hakim mengabulkan gugatan penggugat untuk membatalkan sertipikat hak pakai atas tanah dikarenakan sertipikat ganda/ tumpang tindih atau dapat dikatakan cacat hukum. Dengan demikian dikarenakan adanya pembatalan sertipikat hak atas tanah karena penerbitan sertipikat didasarkan pada sertipikat yang cacat hukum yang mana data yuridis tidak sesuai dengan data fisik sehingga hal ini menimbulkan dampak hukum baik kepada Pihak Penggugat, Pihak Tergugat maupun Pihak yang namanya tercantum dalam sertipikat. Maka dari itu berdasarkan Putusan Peradilan Tata Usaha Negara tersebut, Kepala Kantor Wilayah Badan Pertanahan Nasional Provinsi Kalimantan Barat mengeluarkan Keputusan Nomor : 01/Pbt/BPN- 61/VIII/2019. Kata Kunci : Analisis, Pembatalan, Hak Atas Tanah ABSTRACT  A certificate as proof of title, is issued for the benefit of the relevant rights holder, in accordance with the physical data contained in the measurement letter and the juridical data that has been registered in the land book. In Indonesia, the registration of land rights is based on a negative system, which means that the certificate can be canceled due to a reason that cancels it (for example in a procedure that does not meet the requirements). The method used in this research is a normative method. Normative legal research is legal research on secondary data in the form of library research which is carried out by examining library materials in the form of primary, secondary and tertiary data. Based on the research results, it was found that with the PTUN decision Number 12/G/PTUN-PTK/2004, it can be seen that the panel of judges granted the plaintiff's lawsuit to cancel the certificate of use rights to land because the certificate was double/overlapping or could be said to be legally flawed. Thus, due to the cancellation of the land title certificate because the issuance of the certificate was based on a legally flawed certificate where the juridical data did not match the physical data, this resulted in legal impacts for both the Plaintiff, the Defendant and the Party whose name was listed on the certificate. Therefore, based on the State Administrative Court Decision, the Head of the Regional Office of the National Land Agency for West Kalimantan Province issued Decision Number: 01/Pbt/BPN- 61/VIII/2019.
