Abstract

Polygamy has a condition in terms of justice. Something that can often not be realized by husbands who do polygamy. In Q.S. An-Nisa verse 129 the justice referred to is in terms of feelings of affection and love, husbands should not have mutual respect for each other. However, in the phenomenon of polygamy these things are very difficult to realize, the justice applied so far is in terms of giving the same nominal amount, the division of a balanced turn between each other and according to the husbands it has been considered a justice even though according to the wives in terms of compassion and love has not materialized only by equal division, because compassion and love is something that is difficult to divide equally

Abstract

Abstract : This study suggests about the value of moral aqidah education in Madrasah Ibtidaiyah contained in Surah Luqman verses 12-19, This study aims to obtain an overview of the educational value of morals contained in Surah Luqman verses 12-19 which examines the Tafsir Ath-Thabari. The type of research used is library research by examining library materials related to the subject matter of the study by reading and studying books or other written sources that are relevant to the research title contained in the library sources. Through library research, the results of this study are as follows: First, Akhlak Akidah Education is teaching that can direct students to be able to get used to having noble character. Second, the value of moral aqidah education in Madrasah Ibtidaiyah generally contains values ??about faith and belief in order to stick to Islam and only believe in Allah SWT. as well as commendable in everyday life. Third, Luqman's teaching to his children who can be used as role models in the teaching process at school and at home. Keywords: Aqidah morals, Educational values, Surah Luqman Abstrak: Penelitian ini mengemukakan tentang nilai pendidikan akidah akhlak di Madrasah Ibtidaiyah yang terkandung dalam surah Luqman ayat 12-19, Penelitian ini bertujuan untuk memperoleh gambaran terhadap nilai pendidikan akidah akhlak yang terkandung dalam surah Luqman ayat 12-19 yang mengkaji pada Tafsir Ath-Thabari. Jenis penelitian yang digunakan adalah penelitian kepustakaan (Library Research) dengan meneliti bahan-bahan kepustakaan yang berkaitan dengan pokok masalah penelitian dengan membaca dan menelaah buku-buku atau sumber tertulis lainnya yang relevan dengan judul penelitian yang terdapat dalam sumber pustaka. Melalui penelitian kepustakaan (Library Research), maka hasil penelitian ini sebagai berikut: Pertama, Pendidikan Akidah Akhlak merupakan pengajaran yang dapat mengarahkan peserta didik untuk dapat membiasakan berakhlak mulia. Kedua, Nilai pendidikan akidah akhlak di Madrasah Ibtidaiyah secara garis besar mengandung nilai tentang keimanan dan keyakinan agar tetap berpegang teguh pada Agama Islam dan hanya beriman kepada Allah SWT. serta berakhlak terpuji pada kehidupan sehari-hari. Ketiga, Pengajaran Luqman kepada anaknya yang dapat dijadikan teladan dalam proses pengajaran disekolah maupun dirumah. Kata Kunci: Akidah akhlak, Nilai Pendidikan, Surah Luqman.

Abstract

Abstract:The principles of Islamic Jurisprudence are frequently employed by courts to legitimize marriage dispensation cases involving prospective brides and grooms who have not yet reached the legal minimum age for marriage, thereby allowing them to marry legally. This study is motivated by the perception that courts tend to readily approve such dispensations by referencing the principles of Islamic Jurisprudence as a primary legal consideration. Judges often cite "very urgent reasons" based on the emotional closeness and duration of the relationship between the two prospective brides and grooms. However, trial findings reveal that many of these relationships lasted only two to four months. This discrepancy prompts a deeper analysis of the judges’ reasoning and the appropriateness of applying the principles of Islamic Jurisprudence in each case. This research adopts a normative legal approach with a case study method, focusing on the legal reasoning employed by judges in granting marriage dispensations. The findings indicate that the primary justification offered by judges is the emotional bond between the young couples, along with concerns about potential immoral behaviour if marriage is delayed. The Islamic Jurisprudence principles—particularly those addressing considerations of public benefit (maslahah) and potential harm (mafsadah)—are used to support such rulings. However, the application of these principles in several cases appears inconsistent with the actual legal facts presented during the trial.   Keywords: Islamic Jurisprudence Principles, Marriage Dispensation, Legal Consideration
