ABSTRAK Penelitian ini dilatarbelakangi oleh maraknya praktik persaingan usaha tidak sehat dalam ekonomi digital Indonesia, khususnya dugaan diskriminasi dan penyalahgunaan posisi dominan oleh PT Shopee International Indonesia dan PT Nusantara Ekspres Kilat dalam layanan kurir di platform Shopee, yang berpotensi melanggar UU No 5 Tahun 1999. Tujuan penelitian adalah menganalisis praktik diskriminasi dan penyalahgunaan posisi dominan oleh kedua perusahaan serta penyelesaian perkara oleh KPPU. Metode yang digunakan adalah hukum normatif dengan pendekatan perundang-undangan dan analisis kualitatif-deskriptif berdasarkan studi kasus KPPU nomor 04/KPPU-I/2024. Hasil penelitian menunjukkan kedua perusahaan terbukti melakukan penyalahgunaan posisi dominan dan diskriminasi, namun proses hukum dihentikan setelah mereka mengajukan perubahan perilaku dan menandatangani pakta integritas. Pakta tersebut memuat pengakuan Shopee atas pelanggaran, kesediaan mengubah perilaku, serta komitmen mematuhi aturan, dengan pengawasan berkelanjutan dari KPPU. Rekomendasi menegaskan pentingnya pengawasan ketat dan penegakan hukum konsisten untuk mencegah praktik serupa dan menjaga persaingan usaha sehat di Indonesia. ABSTRACT This study is motivated by the widespread occurrence of unfair business competition practices in Indonesia's digital economy, particularly allegations of discrimination and abuse of dominant position by PT Shopee International Indonesia and PT Nusantara Ekspres Kilat in courier services on the Shopee platform, potentially violating Law No. 5 of 1999. The study aims to analyze how these companies engaged in discriminatory practices and abuse of dominance, as well as the dispute resolution process by the Business Competition Supervisory Commission (KPPU). The research method used is normative legal research with a statutory approach and qualitative-descriptive data analysis based on the KPPU case number 04/KPPU-I/2024. Findings reveal that both companies were proven to have abused their dominant position and engaged in discriminatory practices; however, the legal process was terminated after they submitted behavior changes and signed an integrity pact. This pact includes Shopee’s acknowledgment of the violations, willingness to change behavior, and commitment to comply with applicable regulations, accompanied by ongoing supervision from KPPU. The study recommends strict supervision and consistent law enforcement to prevent similar practices and maintain healthy business competition in Indonesia.
