Abstract

The enforcement of anti-corruption law in Indonesia not only concerns the punishment of the main perpetrators but also the protection of the judicial process itself. One of the serious threats to the integrity of the judicial system is obstruction of justice, which interferes with the process of investigation, prosecution, and adjudication of corruption cases. Article 21 of the Indonesian Anti-Corruption Law regulates obstruction of justice as an independent offense intended to safeguard the judicial process. However, its practical enforcement often reveals inconsistencies that undermine constitutional justice. This article analyzes obstruction of justice from the perspective of constitutional law by positioning it as a constitutional offense that threatens the fundamental principles of the rule of law and judicial independence. Using a normative juridical method with constitutional, statutory, conceptual, and comparative approaches, this research examines the PT Timah corruption case, particularly the decision of the Pangkalpinang District Court concerning obstruction of justice committed by Toni Tamsil. The findings reveal a significant disparity between the normative framework of Article 21 of the Anti-Corruption Law and its application in judicial practice. The relatively light sentence imposed in the case reflects a broader crisis of constitutional justice in the enforcement of obstruction of justice in Indonesia. The study argues that obstruction of justice should be treated as a constitutional offense because it directly undermines the integrity of the judiciary, weakens anti-corruption efforts, and erodes public trust in the rule of law. Strengthening constitutional interpretation in the enforcement of obstruction of justice is therefore necessary to ensure the protection of judicial independence and the effectiveness of corruption eradication.

Abstract

This study examines the criminalization of adultery and cohabitation in Law No. 1 of 2023 on the Criminal Code (KUHP), focusing on the effectiveness of the absolute nature of the delict under Articles 411 and 412. The main problem identified is the restriction of the subject of the complaint to only include the immediate family, thus creating a legal impasse in accommodating living law, as well as the communal community's unrest over violations of decency in their neighborhood. The purpose of this study is to formulate an ideal formulation of more adaptive law enforcement through normative legal research methods with a legislative and conceptual approach. The results of this study indicate that restricting the right to complain risks triggering vigilante justice (eigenrichting), thus requiring a reorientation of the paradigm through the reconstruction of the nature of the delict into a relative complaint delict. In conclusion, this study offers an ideal formulation in the form of expanding the legitimacy of complainants to include four main pillars, namely husband or wife, parents, children, and traditional leaders or community leaders. This mechanism for making complaints has included traditional authority as a way of moderating the role of social filter in protecting individual privacy and family integrity, yet achieving a balance with the need to maintain socio-cultural peace through local culture and ethics of the Indonesian nation as well as to create a situation where complaint mechanisms are used only as a last resort (the principle of ultimum remedium).

Abstract

The formulation of the National Criminal Code through Law Number 1 of 2023 highlights the importance of reforming sentencing theory to anticipate legal and social developments in Indonesia. This study adopts a normative qualitative approach, taking into account the evolution of sentencing paradigms. The findings reveal that the sentencing theory in the new Criminal Code has shifted from a retributive model to an integrative model. It combines restorative justice, absolute, and relative theories. Sentencing today is not solely aimed at punishment, but also at restoring social relations and protecting human rights. The introduction of more diverse types of punishment, the recognition of corporations as legal subjects, and the establishment of sentencing standards as judicial guidelines reflect this reform. In conclusion, a more humanistic and responsive national criminal law policy depends on the development of sentencing theory.
