Abstract

Transfer of Mortgage and Cessie Rights in Civil Law. Agreements can give rise to legal consequences which are the goals of the parties. Mortgage rights are a type of security right that can be transferred via cessie. Claim rights can be transferred to new creditors in accordance with the Civil Code. Cessie is the replacement of old receivables with new receivables. Laws are needed regarding notification of cessie to debtors and executorial powers in decisions must ensure legal certainty.
