<![CDATA[ABSTRACT This study aims to obtain data and information on the implementation of the goods delivery agreement between the Distributor and Mairu Coffee in Pontianak City, to reveal the factors causing the Distributor's default to Mairu Coffee for the delay in the delivery of raw materials in Pontianak City, to reveal the legal consequences of the Distributor's default to Mairu Coffee for the delay in the delivery of raw materials in Pontianak City and to reveal efforts that can be made by Mairu Coffee to the Distributor for the delay in the delivery of raw materials in Pontianak City. This study examines the Distributor's Default to Mairu Coffee for the Delay in the Delivery of Raw Materials in Pontianak City. The agreement made between the Distributor of raw materials and Mairu Coffee, which is located on Jalan M. Sohor, Gang Sederhana Number 2, Pontianak City, was made verbally because it was customary and had been going on for quite a long time, but was hampered by the delay in the delivery of goods, causing problems with the shortage of raw materials for customers. This caused problems between the Distributor and the owner of the Cafe. The results of the study show that the implementation of the goods delivery agreement between the Distributor and Mairu Coffee in Pontianak City has not been carried out as agreed because it turns out that the delivery of goods is not in accordance with what has been agreed, there are problems with delivery that is not on time and the goods delivered are not in accordance with the amount. That the factors causing the Distributor's default to Mairu Coffee for the delay in delivery of raw materials in Pontianak City are due to internal and external factors that occur where the internal causative factor is due to limited human resources so that they cannot fulfill orders on time and there are external factors, namely the goods needed come from outside so that there are weather constraints when shipping goods to West Kalimantan. That the legal consequences of the Distributor's default to Mairu Coffee for the delay in delivery of raw materials in Pontianak City will be sanctions for parties who deliberately commit acts of default based on the agreement made by the parties. That the efforts that can be made by Mairu Coffee to the Distributor for the delay in delivery of raw materials in Pontianak City are to negotiate and ask for clarity from the Distributor about the delay in delivery of goods, this is of course done through deliberation and consensus between the two parties. Suggestions for distributors are to improve logistics management and ensure the availability of raw materials to avoid delays in delivery. Keywords: Default, Delivery, Materials, Raw, Distributor ABSTRAK Penelitian ini bertujuan untuk mendapatkan data dan informasi pelaksanaan perjanjian pengiriman barang antara Distributor kepada Mairu Coffee di Kota Pontianak, mengungkapkan faktor penyebab wanprestasi pihak Distributor kepada Mairu Coffee atas keterlambatan pengiriman bahan baku di Kota Pontianak, mengungkapkan akibat hukum wanprestasi pihak Distributor kepada Mairu Coffee atas keterlambatan pengiriman bahan baku di Kota Pontianak dan mengungkapkan upaya yang dapat dilakukan oleh pihak Mairu Coffee kepada pihak Distributor atas keterlambatan pengiriman bahan baku di Kota Pontianak. Penelitian ini mengkaji tentang Wanprestasi Pihak Distributor Kepada Mairu Coffee Atas Keterlambatan Pengiriman Bahan Baku Di Kota Pontianak. Perjanjian yang dilakukan antara Distributor bahan baku dengan pihak Mairu Coffee yang beralamat dijalan M. Sohor, Gang Sederhana Nomor 2 Kota Pontianak dilakukan dengan cara lisan dikarenakan telah terbiasa dan sudah berlangsung cukup lama, namun sempat terkendala dengan adanya keterlambatan pengiriman barang, sehingga menimbulkan permasalahan kekurangan bahan baku untuk pelanggan. Hal ini menyebabkan terjadinya masalah antara Distributor dengan pemilik Caffee. Hasil penelitian yang dicapai menunjukkan bahwa pelaksanaan perjanjian pengiriman barang antara Distributor kepada Mairu Coffee di Kota Pontianak belum terlaksana sebagaimana yang diperjanjikan karena ternyata pengiriman barang tidak sesuai dengan yang telah disepakati terdapat persoalan pengantaran yang tidak tepat waktu serta barang yang diantar tidak sesuai jumlahnya. Bahwa faktor penyebab wanprestasi pihak Distributor kepada Mairu Coffee atas keterlambatan pengiriman bahan baku di Kota Pontianak adalah dikarenakan faktor dari dalam serta dari luar yang terjadi di mana faktor penyebab dari dalam adalah karena keterbatasan sumber tenaga sehingga tidak dapat memenuhi pesanan tepat waktu serta adanya faktor dari luar yaitu barang yang diperlukan berasal dari luar sehingga terjadi kendala cuaca saat pengiriman barang ke Kalimantan Barat. Bahwa akibat hukum wanprestasi pihak Distributor kepada Mairu Coffee atas keterlambatan pengiriman bahan baku di Kota Pontianak akan adanya sanksi bagi pihak yang sengaja melakukan Tindakan wanprestasi berdasarkan perjanjian yang dilakukan oleh para pihak. Bahwa upaya yang dapat dilakukan oleh pihak Mairu Coffee kepada pihak Distributor atas keterlambatan pengiriman bahan baku di Kota Pontianak adalah dengan melakukan negosiasi serta meminta kejelasan pada Distributor tentang keterlambatan pengiriman barang, hal ini tentu saja dilakukan dengan jalan musyawarah dan mufakat diantara kedua belah pihak. Saran bagi distributor perlu meningkatkan manajemen logistik dan memastikan ketersediaan bahan baku agar tidak terjadi keterlambatan dalam pengiriman.
