Abstract

Cyberbullying poses a serious threat to the safety and well-being of individuals, especially children and adolescents. In Indonesia, the number of adolescents who are victims of cyberbullying is reported at 80%, and almost every day adolescents experience cyberbullying. According to the United Nations Children's Fund (UNICEF) report in 2016, cyberbullying victims in Indonesia reached 41-50%. This research specifically discusses the handling of cyberbullying cases in the perspective of cyber law in Indonesia. This research uses a literature method with a juridical normative approach, which examines positive legal norms related to cyberbullying in Indonesia through analysis of laws and legal documents. This approach is strengthened by Soerjono Soekanto's legal protection theory and law enforcement theory to evaluate the effectiveness of victim protection and obstacles in the law enforcement process. By analyzing existing cases, this research identifies the main challenges in the criminal prosecution process as follows: The elements of the crime are difficult to prove, the judicial process is slow, and victim protection is lacking. In addition, this study explores the role of social media in promoting cyberbullying and the implications for prevention efforts. Based on the research, this paper suggests several solutions, including expanding the definition of cyberbullying in the law, increasing the capacity of law enforcement agencies in handling digital incidents, and developing educational programs to prevent and address cyberbullying.   Abstrak Cyberbullying menimbulkan ancaman serius terhadap keselamatan dan kesejahteraan individu, terutama anak-anak dan remaja. Di Indonesia, jumlah remaja yang menjadi korban cyberbullying dilaporkan sebesar 80%, dan hampir setiap harinya remaja mengalami cyberbullying. Menurut laporan United Nations Children’s Fund (UNICEF) pada tahun 2016, korban cyberbullying di Indonesia mencapai 41-50%. Penelitian ini secara khusus membahas mengenai penanganan kasus cyberbullying dalam perspektif hukum siber di Indonesia. Penelitian ini menggunakan metode pustaka dengan pendekatan normatif yuridis, yang menelaah norma hukum positif terkait cyberbullying di Indonesia melalui analisis undang-undang dan dokumen hukum. Pendekatan ini diperkuat dengan teori perlindungan hukum dan teori penegakan hukum Soerjono Soekanto untuk mengevaluasi efektivitas perlindungan korban serta hambatan dalam proses penegakan hukum. Dengan menganalisis kasus-kasus yang ada, penelitian ini mengidentifikasi tantangan-tantangan utama dalam proses penuntutan pidana sebagai berikut: Unsur-unsur kejahatannya sulit dibuktikan, proses peradilannya lambat, dan perlindungan korbannya kurang. Selain itu, penelitian ini mengeksplorasi peran media sosial dalam mempromosikan cyberbullying dan implikasinya terhadap upaya pencegahan. Berdasarkan penelitian tersebut, tulisan ini menyarankan beberapa solusi, antara lain memperluas definisi cyberbullying dalam undang-undang, meningkatkan kapasitas lembaga penegak hukum dalam menangani insiden digital, dan mengembangkan program pendidikan untuk mencegah dan mengatasi cyberbullying
