Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis unsur-unsur perbuatan memungut hasil hutan bukan kayu tanpa izin dan dasar pertimbangan hakim dalam Putusan Nomor 122/Pid.B.L.H/2018/PN.Makale, terkait memanen atau mengumpulkan hasil hutan di hutan tanpa mempunyai izin dari pejabat yang berwenang. Penelitian ini dilakukan di Kabupaten Tana Toraja Sulawesi Selatan dengan memilih dan menganalisis putusan hakim Pengadilan Negeri Makale. Hasil penelitian menunjukkan bahwa penerapan unsur-unsur hukum terhadap delik memungut hasil hutan bukan kayu tanpa izin yang dilakukan oleh terdakwa telah telah benar karena tercapai unsur-unsur; pertama, Barang siapa, yaitu Nonot Tri Rijono, kedua, unsur menebang memanen atau memungut hasil hutan, ketiga, unsur tanpa memiliki hak atau izin dari pejabat yang berwenang telah terpenuhi. Pertimbangan hukum hakim bahwa terdakwa yaitu Nonot Tri Rijono alias Nonot terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana yakni, memanen hasil hutan di dalam hutan tanpa memiliki hak atau izin dari pejabat yang berwenang. This study aims to determine and analyze the elements of the act of collecting non-timber forest products without a permit and the basis for the judge's consideration in Decision Number 122 / Pid.B.L.H / 2018 / PN.Makale, related to harvesting or collecting forest products in the forest without having a permit from an authorized official. This study was conducted in Tana Toraja Regency, South Sulawesi by selecting and analyzing the verdict of the Makale District Court judge. The results of the study indicate that the application of legal elements to the crime of collecting non-timber forest products without a permit committed by the defendant has been correct because the elements have been achieved; first, Whoever, namely Nonot Tri Rijono, second, the element of cutting down, harvesting or collecting forest products, third, the element without having the right or permission from an authorized official has been fulfilled. The judge's legal consideration that the defendant, namely Nonot Tri Rijono alias Nonot, was proven legally and convincingly guilty of committing a crime, namely, harvesting forest products in the forest without having the right or permission from an authorized official.

Abstract

This study aims to analyze law enforcement against theft of non-timber forest products (pine resin) in Tana Toraja and inhibiting factors in law enforcement. This research is normative-empirical research using a statutory approach, conceptual approach, and sociological enforcement with data sources in the form of observations, documentation, and interviews with the police, prosecutors, and judges who handle the case. The results of this study indicate that law enforcement against the crime of theft of forest products in Tana Toraja Regency substantially uses Law Number 41 of 1999 concerning Forestry, but structurally, law enforcers are still less effective in handling it. While the inhibiting factors affecting law enforcement, namely structurally, the police are still less effective in acting according to the mandate of the law, there are still unscrupulous officials who intervene in the taking of pine resin; and related facilities or facilities are not adequate in supporting the implementation of law enforcement against the crime of pine resin theft.
