Abstract

The Indonesian Ulema Council (MUI) fatwa prohibits interfaith marriage based on Islamic law, which emphasizes the principle of maslahah (public interest). On the other hand, state regulations through the Marriage Law do not explicitly prohibit it but require compliance with each religion’s legal provisions. This study employs a qualitative method with a descriptive-analytical approach to examine the dynamics of the MUI fatwa, state regulations, and social realities regarding interfaith marriage in Indonesia. Data were obtained through library research and the analysis of Islamic legal documents and legislation. The findings indicate that although the MUI fatwa has a strong foundation in Islam, social practices reflect diverse perspectives. Some couples seek alternatives, such as marrying abroad or undergoing administrative religious conversion. This controversy highlights the complexity of the relationship between Islamic law, state regulations, and human rights in a pluralistic society. Policies should consider legal, social, and religious aspects.
