Abstract

The development of digital technology has had a major impact on social interaction patterns, including in terms of deviant sexual behavior in the virtual realm. One case that has emerged is the existence of the "Incestuous Fantasy" group on the Facebook platform, which has become a place for the spread of deviant sexual content based on incest virtually. This study aims to analyze this phenomenon through the perspective of Islamic jurisprudence, a branch of Islamic jurisprudence that discusses Islamic criminal law. The method used is a qualitative-descriptive approach with a juridical and normative analysis of classical Islamic jurisprudence texts, and is associated with the reality of virtual sexual crimes in the digital era. The results of the study show that the activities in the group fulfill the elements of jarimah (criminal acts) in Islam, especially related to the jarimah of zina, fahisyah (vile acts), and the spread of evil. Even though it occurs in the virtual realm, Islamic jurisprudence views these actions as a form of crime that damages morals and social order, so that the perpetrators can still be subject to ta'zir punishment. This study emphasizes the importance of updating Islamic law in responding to the challenges of information technology-based sexual crimes.

Abstract

The issue of gender equality in the world of work is one of the contemporary issues that continues to be a concern in Islamic discourse. This article aims to examine fiqh's view on women's involvement in the career world and the  limitations of shari'i that accompany it. Using a normative-theological approach, this article examines the postulates from the Qur'an, Hadith, and the views of classical and contemporary scholars on the role of women in the public sphere. The results of the study show that Islam in principle does not prohibit women from working as long as they maintain moral values, domestic obligations, and do not violate the provisions of sharia. This article also highlights the importance of contextually reinterpreting religious texts in order to be able to respond to the challenges of the times without overriding the basic principles of Islam. The conclusion of this study emphasizes the need  for equitable equality  between men and women in access to employment, as well as the protection of women's rights as individuals and part of the family and society.
