Abstract

Dusun Sendangbiru memiliki beberapa hasil tangkapan laut, yang juga dibuat olahan ikan, antara lain Abon Ikan, sambal ikan tuna yang diolah secara home industry oleh masyarakat setempat. Pemasaran dilakukan secara lokal ataupun secara online. Beberapa produk olahan ikan tersebut telah memiliki Perizinan, PB-UMKU, SPP-IRT sehingga dapat dipasarkan, namun sebagian besar masyarakat kurang memahami tentang pentingnya merek dagang, proses pendaftaran merek dan perizinannya bagi sebuah produk, sehingga masyarakat Dusun Sendangbiru belum mampu bersaing dalam pemasaran produk secara berkelanjutan dalam memanfaatkan hasil produk mereka. Oleh karena itu, kegiatan pengabdian ini bertujuan untuk memberikan pengertian, dan menyampaikan informasi kepada warga masyarakat Dusun Sendangbiru mengenai pentingnya merek dagang,  proses pendaftaran merek dan perizinannya, serta pendampingan pendaftaran Merek Dagang sebagai Upaya perlindungan Merek Dagang terhadap hasil Pengolahan Ikan di Dusun Sendang Biru Kecamatan Sumbermanjing Wetan Kabupaten Malang, dengan harapan  masyarakat Dusun Sendangbiru mampu mewujudkan produk hasil olahan ikan tuna yang memenuhi syarat pemasaran termasuk dalam pemenuhan untuk menciptakan merek dagang.

Abstract

Marriage is a sacred and everlasting agreement. The phenomenon of contract marriage raises issues regarding the legal regulations that bind it. Contract marriage is a marriage based on an agreement to live together for a certain period of time and compensation to certain parties. The desire to fulfill biological needs is one of the objectives of implementing contract marriage. This study uses a normative legal method which is the main reference for the regulations in force in Indonesia. The results of the study explain that contract marriage has no legal force. The legal consequences that arise are that a wife cannot obtain the general rights of a legal wife, and children born from contract marriage do not have a civil relationship with their father.

Abstract

This study examines the practice of unregistered marriage in Tambakrejo Village and its legal implications for women and children. Nikah siri, which is not recorded by the state, remains prevalent in this coastal area due to economic factors, cultural traditions, limited legal education, and complex administrative procedures. Using a juridical-sociological approach and a case study method, the research involved in-depth interviews with community leaders and the collection of secondary data from statutory regulations and previous studies. The findings reveal that local residents do not fully understand the legal consequences of nikah siri, leaving women without rights to alimony, inheritance, or legal protection in divorce cases. Children born from nikah siri also face administrative obstacles in obtaining birth certificates that include their father’s name, which affects access to education, healthcare, and other civil rights. The study emphasizes the need for preventive legal interventions and public legal awareness campaigns by the government to safeguard the rights of women and children, and to encourage the official registration of marriages to ensure legal certainty.
