Abstract

Abstract

HAM is basically God's greatest gift to man in carrying out his duties and functions as khalifatullah without discrimination between one another. However, there are some people who think that in Islamic law does not find the formulation of human rights as the concept of Western-style human rights but only contains the rules of duty and duty to obey God and His law alone. Based on the searches of the verses of the Qur'an and Sunnah it is concluded that Islamic law has formulated the regulation and protection of human rights for human beings. Unlike anthrophocentric Western human rights, human rights in Islamic law not only recognize the right of human beings (huququl 'ibad) but it is based on the basic human obligation to serve Allah Almighty (huququllah). Islamic law establishes the main principles in the protection of human rights that are significant with the objectives of Islamic law namely the principle of protection of religion (hifdz al-din), soul (hifdz al-nafs), reason (hifdz al-'aql), descendants (hifdz al-nasl) and treasure (hifdz al-mal).

Abstract

This research discusses the dynamics of legal politics in the context of Islamic family law reform and transformation. The main focus of this study is how the direction and pattern of changes in Islamic family law are influenced by state policies, social pressures, and responses to the demands of modernity and gender justice. Using a juridical-normative approach and qualitative analysis of legal documents, public policy, and academic discourse, this study identifies two main trends: reform as a normative renewal within the existing legal framework, and transformation as a more profound paradigm shift towards the structure and basic values of Islamic family law This study finds that there are variations in models in the excavation, practice and reform of family law in the world Islam. Variations were also found when the Islamic world carried out the process of transforming family law into national law. The impact of the reform and transformation of family law in Indonesia is that the classical fiqh books that were originally used as the main reference and considered sacred, have lost their sacredness. However, the reform and transformation of family law in Indonesia has not reduced the independence of religious judges in exploring and finding more contextual Islamic law. This research is expected to make a conceptual contribution in formulating a political and legal direction that is responsive, fair, and rooted in progressive Islamic values.

Abstract

Childfree is an agreement made by a husband and wife not to have children during their marriage. There are manyreasons why someone and their partner have a view like this. The reasons are: (1) Economic Factors, (2) Mental orPsychological Factors, (3) Personal Factors and Experience, (4) Environmental Factors, (5) Medical Factors, and(6) Educational Factors. This research examines childfree from an Islamic perspective which aims to discuss thephenomenon of childfree which is being stirred up and reaping debate in society and is motivated by cases that arecurrently being discussed. This study uses a qualitative approach by using a literature review in collecting data. Thesources used as references in this research are the Al-Qur'an, scientific journals, Hadith, and other sources. In Fiqh, childfree is a decision that is prohibited in Islam because the application of childfree is based on reasons that seemtoo mundane such as the economy, education, environment, and others. Whereas in Islam it has been explained thatchildren have many advantages and blessings in this world and the afterlife. Even though no verse directly prohibitschildfree, the choice for childfree-ness can be said to be a choice that cannot be justified or blamed because it is anindividual right or a right that has been decided with the family which cannot be intervened by other people's views.
