Abstract

ABSTRAK Perlindungan hukum bagi pekerja perempuan terhadap hak cuti haid sangat urgen penerapannya untuk mencegah terjadinya diskriminasi gender dalam lingkup ketenagakerjaan. Sehingga fokus pada penelitian ini adalah mengenai bagaimana UU Ketenagakerjaan dalam perlindungan hukum, saksi, dan faktor yang menyebabkannya hak cuti haid ini tidak diterapkan. Tujuan dari penelitian ini adalah untuk menganalisis perlindungan hukum pekerja perempuan serta sanksi bagi pengusaha yang tidak memberikan hak cuti haid. Metode penelitian yang digunakan adlah metode kepustakaan (library research) dengan pendekatan penelitian yuridis normatif dan pengolahan data analisis kualitatif. Hasil dari penelitian ini menunjukan bahwa (1) Perlindungan hukum terhadap pekerja perempuan yakni perlindungan hukum preventif dan perlindungan hukum represif. Perlindungan hukum preventifnya adalah dibentuknya UU Nomor 13 Tahun 2003 mengenai Ketenagakerjaan. Sedangkan perlindungan hukum represifnya penindaklanjutan yang ditempuh oleh perusahaan ataupun pekerja atas pelanggaran yang terjadi atas hak cuti haid. (2) Sanksi yang diberikan jika terjadi pelanggaran atas hak cuti haid dan upahnya tercantum dalam Pasal 186 Ayat (1) UU Ketenagakerjaan yakni kurungan pidana selama 1 bulan s.d. lama 4 tahun dan juga dikenakan denda sebesar Rp. 10.000.000 (sepuluh juta rupiah) s.d. Rp. 400.000.000 (empat ratus juta rupiah). (3) Terdapat 3 faktor dari tidak terpenuhinya hak cuti haid bagi pekerja perempuan, yaitu terbatasnya pengetahuan pekerja perempuan atas haknya mengenai hak cuti haid, kurangnya sosialisasi atau pendidikan dari perusahaan dan pemerintah, dan kurangnya pemahaman dari pengusaha mengenai ketentuan yang terdapat pada peraturan perundang-undangan yang berlaku di Indonesia. Kata Kunci: Perlindungan Hukum, Cuti Haid, Ketenagakerjaan ABSTRACT It is urgent to implement legal protection for female workers regarding the right to menstrual leave to prevent gender discrimination in the employment sphere. So the focus of this research is on how the Employment Law provides legal protection, witnesses, and the factors that cause the right to menstrual leave not to be implemented. The aim of this research is to analyze the legal protection of female workers as well as sanctions for employers who do not provide menstrual leave rights. The research method used is a library research method with a normative juridical research approach and qualitative analysis data processing. The results of this research show that (1) Legal protection for female workers, namely preventive legal protection and repressive legal protection. The preventive legal protection is the establishment of Law Number 13 of 2003 concerning Employment. Meanwhile, repressive legal protection means follow-up actions taken by companies or workers for violations of menstrual leave rights. (2) The sanctions given if there is a violation of the right to menstrual leave and wages are stated in Article 186 Paragraph (1) of the Manpower Law, namely criminal imprisonment for 1 month to 1 month. 4 years and also subject to a fine of Rp. 10,000,000 (ten million rupiah) up to. Rp. 400,000,000 (four hundred million rupiah). (3) There are 3 factors in the non-fulfillment of menstrual leave rights for female workers, namely limited knowledge of female workers regarding their rights regarding menstrual leave rights, lack of socialization or education from companies and the government, and lack of understanding from employers regarding the provisions contained in statutory regulations. invitation valid in Indonesia. Abstract

This study examines the regulation of foreign workers (TKA) in Indonesia and the implications of the Constitutional Court Decision Number 168/PUU-XXI/2023 on TKA regulations. The focus is to analyze regulatory changes before and after the decision, as well as its impact on prioritizing local workers, technology transfer, and TKA licensing. This research employs a normative juridical method with a statutory approach, based on an analysis of legal documents such as laws and court decisions. The findings reveal that the Constitutional Court's decision strengthens the prioritization of local workers, technology transfer, and TKA oversight. The implementation of this decision is expected to reduce reliance on foreign workers, enhance the competitiveness of local labor, and promote inclusive development. The government is urged to reinforce oversight, prioritize training for local workers, and conduct periodic evaluations of TKA policies to support the independence of Indonesian labor in the global era
