Abstract

The trademark registration system in Indonesia constitutionally adheres to the First to File principle, namely that the right to a trademark is granted to the party who first legally files for registration. However, in practice, this principle often gives rise to legal issues, especially when there is a dispute over trademark ownership between the party who registered first and the party who first used the trademark in real terms. This phenomenon indicates a legal vacuum in the trademark registration system in Indonesia, where the First to File principle does not always reflect fair and substantial legal protection for the actual trademark owner. This study aims to further analyze the weaknesses of the First to File principle, as well as to examine the extent to which the applicable legal system can protect legitimate trademark ownership, especially in the context of dispute resolution.

Abstract

Perkembangan pesat teknologi Kecerdasan Buatan (Artificial Intelligence/AI) di Indonesia menghadirkan berbagai tantangan hukum dan etika, terutama terkait potensi penyalahgunaan seperti pelanggaran privasi, diskriminasi algoritmik, serta penyebaran informasi palsu. Regulasi yang ada, seperti Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) serta Undang-Undang Perlindungan Data Pribadi (UU PDP), belum secara spesifik mengatur tata kelola AI, sehingga menimbulkan kekosongan dan inkonsistensi hukum dalam penanganan isu-isu tersebut. Artikel ini menggunakan pendekatan yuridis normatif melalui analisis peraturan perundang-undangan dan analisis konseptual untuk mengkaji urgensi pembentukan kerangka regulasi khusus yang adaptif, progresif, dan berlandaskan pada keadilan digital. Hasil kajian menunjukkan bahwa Indonesia memerlukan regulasi komprehensif yang menjamin transparansi, akuntabilitas, dan tanggung jawab dalam pemanfaatan AI, disertai pembentukan lembaga pengawas independen serta peningkatan literasi digital masyarakat. Implementasi kebijakan tersebut diharapkan mampu memberikan perlindungan hukum yang efektif dan mendorong tata kelola AI yang berkeadilan di era transformasi digital.
