Abstract

Social and Environmental Responsibility is a form of company commitment in supporting sustainable development by considering social, economic, and environmental aspects. As one of the State-Owned Enterprises, it has implemented a pattern as part of a sustainable business strategy. This study aims to analyze the effectiveness of the implementation of social and environmental responsibility carried out by PTPN VI Jambi in economic, environmental, and legal and governance aspects. In the economic aspect, TJSL PTPN VI focuses on improving community welfare through Small and Medium Enterprises empowerment programs and increasing access to education and health. From the environmental side, the company implements policies that are oriented towards sustainability, such as reforestation programs, waste management, and carbon emission reduction. Meanwhile, in the legal and governance aspects, PTPN VI ensures compliance with applicable regulations, transparency in reporting, and strict program evaluation. The results of the analysis show that the TJSL program that has been implemented has had a positive impact on the surrounding community, increased environmental awareness, and strengthened more accountable corporate governance. With transparent reporting and wide accessibility of information, TJSL PTPN VI can be an effective implementation model for other companies in carrying out their social responsibilities.

Abstract

This study aims to analyze the regulation of Village-Owned Enterprises (BUMDes) as legal entities and their liability for third-party losses within the framework of Indonesian legislation. The research employs a normative legal method with statutory and conceptual approaches to examine the synchronization of existing regulations. The findings indicate that when BUMDes are established in the form of a Limited Liability Company (PT), the formation process must comply with two legal frameworks: Government Regulation No. 11 of 2021 on Village-Owned Enterprises and Law No. 40 of 2007 on Limited Liability Companies. Regarding liability, BUMDes as a legal entity are obliged to compensate third-party losses in accordance with legal responsibility principles. However, the scope of liability differs depending on whether the loss arises from the negligence of management or from the fault of the BUMDes itself. This study concludes that the regulation of BUMDes as legal entities, particularly in the form of PT, faces regulatory dualism that may create legal uncertainty. Therefore, a specific regulation is required to comprehensively govern the legal status of BUMDes and their liability mechanisms, thereby strengthening legal certainty and enhancing their role as drivers of rural economic development.

Abstract

Artikel ini bertujuan untuk memaparkan dan menganalisis beberapa masalah yang di terkait dengan pendaftaran tanah. kegiatan ini dilakukan di Kantor Kecamatan Sungai Gelam Kabupaten Muaro Jambi, Provinsi Jambi. Ini merupakan pengabdian kepada masyarakat. Setelah acara sosialisasi, ada 50 (lima puluh) orang yang hadir. Mereka termasuk Camat Sungai Gelam, kepala desa di lingkungan Kecamatan Sungai Gelam, pengurus Badan Usaha Milik Desa, dan anggota masyarakat lokal. Kegiatan sosialisasi terjadi melalui diskusi dan pendapat antara anggota tim dan individu yang hadir. Hasil kegiatan menunjukkan bahwa sangat erat hubungannya antara pendaftaran tanah dan kepastian hukum. Proses pendaftaran tanah mengakui dan melindungi hak kepemilikan tanah secara legal dengan memberikan sertifikat tanah sebagai bukti hukum. Kepastian hukum memberikan pemilik tanah rasa aman yang lebih besar, meningkatkan keamanan mereka, dan memberikan akses ke berbagai sumber keuangan. Sebaliknya, kepastian hukum yang diberikan oleh pendaftaran tanah memberikan manfaat umum bagi masyarakat. Transparansi dan keteraturan dalam pendaftaran tanah mencegah konflik agraria dan memudahkan pengelolaan lahan oleh pemerintah, yang pada gilirannya membantu pembangunan infrastruktur dan perencanaan tata ruang yang lebih baik. Oleh karena itu, untuk menciptakan ketertiban dalam pengelolaan dan pemanfaatan lahan serta menumbuhkan kepercayaan publik terhadap hukum pertanahan di Indonesia, sistem pendaftaran tanah yang transparan, efektif, dan akuntabel sangat penting.
