Abstract

Women and their struggle for rights in society are always highlighted by researchers in their studies, with issues of inequality, patriarchy, and double burden being central themes, including in relation to women's rights in Islamic studies. This research aims to understand the concept of women's human rights from the perspective of Islamic law. The method used is descriptive qualitative with the use of library research. In library research, the method used to collect research data consists of selected, searched, presented, and analyzed library data. The result of this research is that women's rights are always protected by Islamic law; however, deeply entrenched social, cultural, traditional, and political norms build biases against women's rights, under the pretext of Islamic dictates. Considering the above findings, it is recommended that awareness be increased regarding women's rights under Islamic law. This research contributes to the issue of uplifting the dignity and status of women within families and communities, so that issues of inequality and other accompanying matters do not become prolonged problems without clear solutions.

Abstract

This study aims to analyze the factors that cause divorce from an Islamic perspective and its impact on families, especially children, by emphasizing the importance of maintaining the integrity of the household. This study uses a qualitative approach with a literature study method, examines Islamic teachings on divorce, and identifies factors that cause divorce, such as biological, psychological, moral, economic, and sociological factors. The results show that divorce, although allowed in Islam, is strongly discouraged because of its widespread and negative impact, especially on children who are often the most emotionally and socially disadvantaged. This study recommends the importance of strengthening the values of domestic harmony through family education based on Islamic teachings, conflict management in a peaceful way, and providing counseling for couples facing domestic problems. Thus, divorce can be minimized, and the integrity of the family can be maintained in accordance with Islamic values

Abstract

This research aims to examine the minimum age for marriage in Indonesia and Muslim countries from a legal and socio-cultural perspective, and to conduct a comparative analysis. The method used is library research, with a normative juridical approach. The research findings indicate that the legal age for marriage in Muslim countries varies, influenced by legal, social, cultural, and political dynamics in each country. Indonesia has the highest minimum age for marriage, which is 19 years for both men and women. Meanwhile, in other countries like Pakistan and Egypt, the minimum age for marriage is lower, with some countries setting different ages for men and women. This difference is also influenced by the adopted school of thought, such as the Shafi'i school in Indonesia and Malaysia, the Hanafi school in Pakistan and Turkey, and the Maliki school in Morocco. Legal reforms in countries like Turkey and Morocco also reflect the adoption of secularization and gender equality principles. Pakistan stands out as the only country that imposes strict legal sanctions on those who violate the marriage age limit, while other countries like Indonesia rely on marriage dispensation regulations overseen by the courts.
