Abstract

The higher divorce rate in Religious Courts indicates an increase in cases that occur within Islamic families. Especially the issue in the matter of marriage. Religious Courts mostly resolve divorce issues in litigation rather than through peace. The suboptimal application of mediation as an effort to resolve divorce problems is one of the reasons for the high divorce rate in Religious courts. In this study, this article is limited to two main issues; first, what is the concept of mediation and sulh in the settlement of Islamic family law disputes; Second, how to apply mediation and sulh in the settlement of islamic family legal disputes. The benefit of this research is that the public knows more about the concept of alternative or non-court dispute resolution. The purpose of this study is to discuss efforts to resolve Islamic family law disputes through mediation and sulh. Especially the disputes that are the focus of discussion are marital disputes, inheritance disputes and representation. The research method that will be used is the Library Study, which is a literature review of documents, data, reading materials to be studied, and combined with a normative-juridical approach. The results of this study are explained, that 1) The concepts of Mediation and Sulh are literally different but in substance the same, namely both seeking peace in solving problems 2) In the settlement of Islamic legal disputes, both mediation and sulh if optimized properly, then the problems that exist in human life can be resolved in a peaceful and winning way. Mediation and Sulh are looking at the future rather than looking at the past.

Abstract

Marriage is a significant and complex topic in Islamic family law, influenced by various legal, social, and cultural factors. In Indonesia, where the majority of the population is Muslim, Islamic marriage law holds an essential position. However, the dynamics of marriage in Indonesian Muslim society have faced new challenges due to rapid social changes, globalization, and technological advancements. This study aims to systematically map the predominant themes and emerging issues in marriage research within accredited Islamic family law journals through a Systematic Literature Review (SLR). The research questions focus on: (1) What are the dominant trends in publications on marriage in Indonesia in Scopus-indexed journals? (2) What research methods have been used? (3) What novel issues remain underexplored? To answer these questions, this study employs SLR methodology, using the PRISMA framework to filter and analyze relevant literature from 2010 to 2025. A total of 86 articles were selected from various international, Scopus-indexed journals, synchronized with Zotero reference manager and visualized using VosViewer and R Studio for keyword mapping and trends. The findings indicate that research on marriage in Indonesia has predominantly been qualitative, focusing on normative-juridical aspects such as legal frameworks and doctrinal interpretations. The most frequently discussed issues include child marriage, interfaith marriage, polygamy, and the legal age of marriage, often analyzed from legal, social, and religious perspectives. However, the study also identifies research gaps, particularly in empirical studies exploring the practical implications of marriage policies and social realities. This study provides a comprehensive mapping of dominant themes and underexplored research areas, serving as a foundation for future research and policy-making in Islamic family law. In a nutshell, This study concludes that research on marriage in Indonesian Islamic family law has been dominated by normative-juridical approaches, focusing on themes such as child marriage, interfaith marriage, polygamy, and the legal age of marriage. While these studies provide important doctrinal insights, they reveal a lack of empirical and interdisciplinary research that examines the practical implications of marriage policies in society. Future research should bridge this gap by employing socio-legal and empirical approaches, exploring underexamined issues for instance, technological influences, gender justice, and comparative perspectives, thereby enriching both academic discourse and policy development in Islamic family law.

Abstract

Kegiatan pengabdian masyarakat ini dilakukan untuk mendukung Kota Malang menuju Halal Tourism City. Berdasarkan amanat Undang-Undang Nomor 40 Tahun 2022 tentang Penetapan Label Halal sebagai pelaksanaan Pasal 37 UU Nomor 33 Tahun 2014. Target pemerintah pada tahun 2024 seluruh produk makanan, minuman dan obat-obatan wajib mempunyai sertifikat halal. Pelaksanaan pengabdian ini dilakukan kepada pelaku usaha di sepanjang Jalan Tirto Utomo yang memiliki pelaku usaha kecil sampai mikro yang menyediakan pelbagai jenis makanan dan minuman. Peserta diberikan pendampingan dan penyuluhan tentang makanan halal sampai prosedur teknis untuk melakukan sertifikasi halal. Penyuluhan dilakukan untuk memberikan penguatan dan pemahaman tentang pentingnya untuk melakukan sertifikasi halal pada produk yang dipasarkan oleh Mitra. Pelatihan dilakukan untuk memberikan skill dalam penyusunan dokumen yang menjadi prasyarat untuk mendaftarkan ikrar halal Muhammadiyah. Pendampingan dilakukan dengan cara memberikan pengarahan, komunikasi, dan penulisan penyusunan manual SJH (Sistem Jaminan Halal). Pendampingan dilakukan dengan cara mendorong Mitra untuk melakukan pendaftaran sertifikasi halal gratis melalui program SEHATI atau melalui Ikrar Halal Muhammadiyah. Adapaun pengabdian ini dilaksankan melalui tiga  tahapan  yaitu: pra konstruksi,  konstruksi dan pasca   konstruksi.

Abstract

The Indonesian government has implemented diverse initiatives to foster a nonviolent approach to resolving family law conflicts. The study will examine the involvement of governments and their initiatives in advocating for conflict resolution as a viable method for addressing societal concerns. The aggregation of cases handled by multiple courts led to a prolonged resolution of the recorded concerns. This study will focus on two distinct problem formulations. Firstly, we will discuss the government's role in promoting alternative dispute resolution as a solution to difficulties. Secondly, we will examine why government techniques for implementing alternative conflict resolution are superior to resorting to court proceedings for dispute settlement. This research aims to enhance people's understanding of the government's provision of non-judicial or alternative dispute resolution. The report seeks to analyze the government's initiatives in addressing the issue of Islamic family law. This study will utilize library research and significant data regarding specific government initiatives. This will be accomplished using a legal and normative approach. The study findings indicate that the government is actively promoting alternative methods of resolving disputes, such as mediation. This is being done through the implementation of mediation in the courts, improving legal aid services, enacting laws on a large scale, and encouraging the utilization of information and communication technologies. The strategy is executed by promoting mediation and conciliation in all court proceedings, establishing dispute resolution centers, empowering women to reduce disputes related to women, promoting legal education and awareness, and maximizing the utilization of technology and information.
