Abstract

Purpose: To explain the obstacles in the implementation of court decisions, as well as to describe the government's non-compliance in executing court rulings from the perspective of the principles of the rule of law and the principles of a democratic state. Methodology/approach: This research uses a normative approach to analyze legal issues related to the implementation of court decisions by the government, utilizing legislative and bibliographic approaches. Results/findings: The implementation of court decisions is based on the good faith of the government. This government action is justified by the principle that the government cannot be declared bankrupt and the principle of contrarius actus. It is also reinforced by regulations in the legislation. Conclutions: The government's liability is a form of repressive legal action to protect society from unlawful acts by the authorities (onrechtmatig overheidsdaad). However, the implementation of court decisions relies on the good faith of the government. The government's disobedience in executing decisions based on its good faith reflects a violation of the principles of the rule of law and democracy, and the government's actions contradict the principles of good governance. Limitations: This research is limited to normative research and is only of a recommendation nature. The implementation is up to the government to carry out. Contribution: Providing understanding in the development of legal science, and hopefully offering benefits for legal practitioners.

Abstract

Abstrak Asas kelestarian dan berkelanjutan merupakan prinsip fundamental dalam hukum lingkungan yang berfungsi sebagai pilar kebijakan pembangunan di Indonesia. Dalam negara hukum, setiap kebijakan pemerintah, termasuk kebijakan lingkungan, harus berlandaskan hukum dan asas-asas hukum yang mengikat. Artikel ini mengkaji kedudukan dan peran asas kelestarian dan berkelanjutan dalam sistem hukum lingkungan Indonesia serta tantangan implementasinya dalam praktik pembangunan. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual, melalui analisis terhadap UUD 1945, Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, serta doktrin para ahli hukum lingkungan. Hasil kajian menunjukkan bahwa asas kelestarian dan berkelanjutan secara normatif telah diakui sebagai dasar pengelolaan lingkungan dan pembangunan berkelanjutan, sejalan dengan Teori Pembangunan Berkelanjutan (Sustainable Development Theory). Namun, dalam implementasinya asas ini masih sering tereduksi menjadi norma simbolik akibat dominasi orientasi pertumbuhan ekonomi dan lemahnya penegakan hukum. Oleh karena itu, diperlukan penguatan komitmen pemerintah, pengarusutamaan asas berkelanjutan dalam kebijakan pembangunan, serta konsistensi penegakan hukum guna menjamin perlindungan lingkungan hidup dan keadilan antargenerasi. Abstrack The principle of sustainability and sustainable development serves as a fundamental pillar in Indonesia's environmental law, functioning as the cornerstone of national development policy. In a rule-of-law state, every government policy, including environmental policy, must be grounded in binding legal principles and laws. This article examines the position and role of the principle of sustainability and sustainable development within Indonesia's environmental legal system, as well as the challenges in its implementation in development practices. This research employs a normative legal method with legislative and conceptual approaches, through analysis of the 1945 Constitution, Law Number 32 of 2009 on Environmental Protection and Management, and doctrines from environmental law experts. The findings indicate that the principle of sustainability and sustainable development is normatively recognized as the basis for environmental management and sustainable development, aligning with the Sustainable Development Theory. However, in practice, this principle is often reduced to a symbolic norm due to the dominance of economic growth orientation and weak law enforcement. Therefore, strengthening government commitment, mainstreaming the principle of sustainability in development policies, and consistent law enforcement are necessary to ensure environmental protection and intergenerational justice.
