Abstract

Poligami dikaji dalam Al-Qur’an, khusunya pada Surat An-Nisâ ayat 3 dan 129, hadits Nabi Shalallahu ‘Alaihi Wasallam, serta qudwah dari Nabi yang menikahi beberapa isteri. Dari dalil-dalil tersebut muncul tiga permasalahan terkait poligami, yaitu: Apa hukum poligami? Berapa wanita yang boleh dinikahi? Aan apa syarat-syarat poligami? Dari hasil istinbath terhadap dalil-dalil dipahami bahwa poligami hukumnya dibolehkan dengan pendekatan, Al-amri ba’da al-hazhri lil ibâhah. Dan jumlah maksimal wanita yang boleh dinikahi adalah empat wanita yang disimpulkan dari hadits Nabi yang memerintahkan para Shahabat menceraikan kelebihan dari empat isteri mereka. Adapun untuk syarat poligami, metode istinbath hukumnya dengan pendekatan, Asy-syarthu yu’atstsir fil hukmi ‘inda ‘adamihi. Menurut Ibnu Asyûr dalam kitabnya, disebutkan bahwa poligami mengandung kemaslahatan terhadap manusia. Di antara hikmah pensyariatan poligami, ia memperbanyak Umat dan termasuk bagian Maslahah Kulliyat. Poligami mencegah dari zina yang merupakan pembahasan dari Sadduzh Zharâ’i, poligami solusi bagi wanita yang tidak memiliki suami karena jumlah wanita di akhir zaman lebih banyak dari jumlah laki-laki; dan ini bagian dari maslahah yang sifatnya Tahsiniyah bagi individu dan maslahah yang sifatnya Hajiyat bagi Umat di akhir zaman kelak.

Abstract

This paper aims to compare the methodology of tafsir ‘ilmi and I'jaz ilmi on verses related to pure science. Pure science calcification includes natural sciences such as physics, biology, chemistry, mathematics. So the problem under study is the pure sciences or what is known as pure science in two discourses; discourse tafsir ‘ilmi and discourse I'jaz ilmi. From the results of the study, it was found that there was a fundamental difference between the methodology of tafsir ‘ilmi and the methodology of I'jaz ilmi which resulted in two different conclusions. In the discourse of tafsir ‘ilmi research on science, the methodology starts from understanding the kauniyah verses related to science and then connected with science without ensuring the authenticity of the ilmiyah theory concluded so that the results of science studies in tafsir 'ilmi still need to be proven true. In contrast to the methodology of I'jaz Ilmi which began from research on ilmiyah theory which was experimentally proven then the truth was preached by the Qur'an.

Abstract

This article highlights the values of Islamic mercy contained in the concept of Hudud. This article is needed as an answer to the criticism that the concept of hudud in Islam is against human rights (HAM). The type of research used is descriptive qualitative research using the library research method. This article finds that the mercy of Islam is very much reflected in the concept of hudud, starting from the proscription of hudud itself to its enforcement in the community, even when and after the enforcement of hudud, we are prohibited from denouncing, cursing, and berating the perpetrators of criminal acts, even Islam tells us to do good and pray for them. This shows that the concept of hudud in Islam contains values of mercy and is not against human rights.
