Abstract

The phenomenon of hoisting the fictional One Piece flag (Jolly Roger) during Indonesia’s Independence Day sparked debates on freedom of expression and the protection of state symbols. This study examines the legal boundaries of expression within Indonesian criminal law regarding popular culture symbols. Using a normative legal method and statutory approach, the analysis refers to the 1945 Constitution, Penal Code, and Law No. 24 of 2009. Findings show that hoisting the Jolly Roger is not explicitly prohibited, unless it fulfills criminal elements such as insult or incitement. Such symbols are better viewed as peaceful social critique. The state should prioritize education and dialogue.

Abstract

Penelitian ini menganalisis urgensi perumusan konsep halal pharmacy dalam industri herbal Indonesia yang hingga kini belum memiliki definisi baku dalam literatur maupun regulasi. Ketidakjelasan konsep ini menimbulkan ketidakpastian hukum dan menghambat implementasi kewajiban sertifikasi halal sebagaimana diatur dalam UU No. 33 Tahun 2014 dan PP No. 31 Tahun 2019. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual untuk menelaah kesenjangan antara norma dan praktik industri. Temuan menunjukkan bahwa rendahnya tingkat sertifikasi halal dan tingginya potensi kontaminasi non-halal disebabkan oleh lemahnya pengawasan bahan baku, fasilitas produksi, dokumentasi, dan rantai pasok, terutama pada UMKM. Oleh karena itu, standar teknis halal lebih diperlukan daripada sekadar sertifikasi administratif. Penelitian ini merumuskan halal pharmacy sebagai sistem praktik kefarmasian yang mengintegrasikan prinsip kehalalan dalam seluruh rantai produksi, dan memberikan dasar bagi penguatan regulasi teknis di sektor herbal. Abstract This study examines the urgency of formulating a clear concept of halal pharmacy within Indonesia’s herbal industry, which currently lacks a standardized definition in both pharmaceutical literature and halal regulations. The absence of this concept creates legal uncertainty and hinders the effective implementation of mandatory halal certification under Law No. 33/2014 and Government Regulation No. 31/2019. Using a normative juridical method with statutory and conceptual approaches, this research analyzes the gap between regulatory norms and industry practices. The findings show that the low rate of halal certification and the high risk of non-halal contamination stem from weak control of raw materials, production facilities, documentation, and supply chains, particularly among MSMEs. Thus, technical halal standards are needed beyond administrative certification. This study proposes halal pharmacy as a pharmaceutical practice system that integrates halal principles throughout the production chain and provides a foundation for strengthening technical regulations in the herbal sector.
