Abstract

Kajian terhadap lafaz-lafaz dalam Al-Qur’an memiliki posisi penting karena berdampak pada pemahaman hukum dan akidah umat Islam. Penelitian ini berfokus pada analisis komparatif kekuatan makna lafaz يَدٌ (tangan) dalam QS. al-Maidah ayat 38 dan QS. al-Fath ayat 10, ditinjau dari perspektif Khafiy al-Dilalah dalam Ushul Fiqh. Permasalahan muncul karena lafaz yang sama memunculkan makna yang sangat berbeda: dalam QS. al-Maidah ayat 38, kata يَدٌ digunakan dalam konteks hukum hudud terhadap pencurian, tergolong lafaz khafiy karena maknanya jelas secara anatomis tetapi samar dalam penerapan hukumnya, terutama terkait batasan siapa yang wajib dipotong tangan dan syarat-syarat pelaksanaan hudud. Sementara itu, dalam QS. al-Fath ayat 10, lafaz يَدٌ muncul dalam konteks teologis sebagai يَدُ الله (Tangan Allah) yang termasuk lafaz mutasyabih karena hakikat maknanya hanya diketahui oleh Allah SWT, sehingga menimbulkan perbedaan pendekatan antara tafwīḍ yang menyerahkan makna hakikinya kepada Allah, dan takwil yang memaknai secara metaforis sebagai kekuasaan atau pengawasan Allah. Penelitian ini menggunakan metode kualitatif deskriptif dengan analisis komparatif teks dan data diperoleh melalui studi pustaka terhadap Al-Qur’an, kitab tafsir, literatur Ushul Fiqh, serta sumber ilmiah lain. Hasil penelitian menunjukkan adanya perbedaan mendasar antara khafiy dan mutasyabih baik dari sisi sumber kekaburan makna maupun implikasi hukumnya. Temuan ini menegaskan pentingnya ketepatan metodologi dalam memahami lafaz-lafaz Al-Qur’an untuk menghindari kesalahan dalam istinbath hukum maupun penyimpangan akidah.

Abstract

This research aims to comprehensively analyze the concept, models of development, and sustainable governance of productive waqf in Indonesia. Using a qualitative approach through library research, data were obtained from books, scientific journals, regulations, and official reports related to productive waqf management. The findings show that productive waqf has significant potential as an economic and social empowerment instrument when managed professionally and sustainably. The main difference between productive and consumptive waqf lies in asset utilization, where productive waqf focuses on generating sustainable economic value through leasing, business ventures, and investment models. The study highlights the need for strong legal frameworks, competent nazir, and high public literacy to optimize productive waqf as a pillar of inclusive and competitive economic development in Indonesia.

Abstract

This study examines the role of the usul al-fiqh maxim al-hukmu yaduru maa illatihi wujudan wa adaman (a legal ruling revolves with its effective cause in both its existence and nonexistence) as a foundation for the flexibility of Islamic law in responding to contemporary social dynamics. Employing a qualitative library research method, the study analyzes the application of this maxim in both classical cases (such as the prohibition of khamr and the obligation of zakat) and contemporary contexts (including the suspension of Friday prayers and the formulation of Sharia-based policies during the COVID-19 pandemic). The findings indicate that this maxim effectively sustains the relevance of Islamic law by ensuring its conformity with the Maqasid al-Shariah, particularly in safeguarding life (hifz al-nafs) and promoting the public interest (al-maslahah al-ammah). These findings underscore the urgency of applying rational Sharia legal maxims as a foundational basis for the development of positive law oriented toward Islamic values.

Abstract

The trend of delaying marriage in contemporary Muslim societies has increased in line with social, economic, and cultural changes. This phenomenon has sparked normative debates in Islamic law as it conflicts with the recommendation to marry early and raises concerns about moral and social impacts. This study aims to analyze the social and moral implications of delaying marriage age through the perspective of contemporary fiqh using the maqāṣid al-syarī‘ah approach. The research uses a qualitative method with a literature review, with data sources in the form of classical and contemporary fiqh literature, works on maqāṣid al-syarī‘ah, as well as secondary data from official reports from the Central Statistics Agency and BKKBN and relevant scientific articles. The analysis was conducted descriptively and analytically by considering the practice of postponing marriage based on the principle of jalb al-maṣāliḥ wa dar’ al-mafāsid. The results of the study show that postponing marriage can be beneficial if it serves to mature economic, psychological, and social readiness, but has the potential to become harmful if it opens up space for moral violations and weakens self-control. A reinterpretation of the concept of istiṭā‘ah based on maqāṣid is necessary so that legal assessments are contextual and proportional.
