ABSTRAK PENERAPAN RESTORATIVE JUSTICE TERHADAP PECANDU, PENYALAHGUNA DAN KORBAN PENYALAHGUNA NARKOTIKA DI KEJAKSAAN NEGERI PONTIANAK Penelitian ini membahas penerapan Restorative Justice bagi pecandu, penyalahguna, dan korban penyalahguna narkotika di Kejaksaan Negeri Pontianak. Fokus utama penelitian adalah untuk mengidentifikasi serta menganalisis hambatan pelaksanaan Restorative Justice sesuai Pedoman Jaksa Agung Nomor 18 Tahun 2021. Metode yang digunakan adalah pendekatan kualitatif dengan wawancara dan observasi terhadap Kejaksaan, lembaga rehabilitasi, dan instansi terkait. Hasil penelitian menunjukkan bahwa meskipun secara normatif telah tersedia regulasi dan komitmen institusi, realisasi di lapangan masih belum optimal. Beberapa hambatan utama yang diidentifikasi meliputi keterbatasan fasilitas rehabilitasi yang memiliki kerja sama resmi dengan pihak Kejaksaan, beban biaya rehabilitasi yang harus ditanggung secara pribadi oleh pelaku, serta perlunya pelatihan dan keberanian Jaksa, lemahnya koordinasi antar instansi dan respon masyarakat. Kondisi tersebut mencerminkan bahwa sistem sosial yang ada belum sepenuhnya mendukung implementasi restorative justice secara menyeluruh. Dengan demikian, penerapan restorative justice terhadap pecandu, penyalahguna dan korban penyalahguna narkotika dinilai belum berjalan secara efektif. Oleh karena itu, diperlukan peningkatan sarana pendukung, pembiayaan yang memadai, serta penguatan sinergi antar lembaga agar pelaksanaan Restorative Justice dapat berlangsung sesuai dengan pedoman yang telah ditetapkan. ABSTRACT IMPLEMENTATION OF RESTORATIVE JUSTICE TO ADDICTS, ABUSERS, AND VICTIMS OF DRUG ABUSE AT THE PONTIANAK DISTRICT PROSECUTOR"™S OFFICE This research discusses the implementation of Restorative Justice for drug addicts, abusers, and victims of drug abuse at the Pontianak District Prosecutor"™s Office. The main focus of this research is to identify and analyze the challenges in applying Restorative Justice based on the Attorney General"™s Guideline Number 18 of 2021. The research uses a qualitative approach involving interviews and observations with prosecutors, rehabilitation centers, and related institutions. The results of the research shows that even though regulations and institutional commitments exist, the actual implementation in the field is still not optimal. Several main obstacles were found, such as the limited number of rehabilitation centers affiliated with the Prosecutor"™s Office, the rehabilitation costs that offenders must pay on their own, the need for training and courage of prosecutors, weak coordination across institutions, and lack of response from society. This situation shows that the current social system does not fully support the implementation of Restorative Justice. Therefore, the implementation of restorative justice for drug uses, addicts, and victims of drug abuse is considered not effective yet. There needs to be an improvement in supporting facilities, sufficient funding, and stronger cooperation between institutions so that the implementation of Restorative Justice can run well and follow the guideline.
