Abstract

Tujuan penelitian menganalisis dasar pertimbangan hakim dalam menetapkan hadhanah dan untuk mengetahui prespektif kompilasi hukum islam dalam pemberian hadhanah. Penelitian ini menggunakan tipe penelitian normatif empiris Hasil penelitian ini menunjukan bahwa Terdapat perbedaan pendapat hakim dalam memutus perkara hadhanah yang memiliki kondisi ibu murtad, pada Putusan Nomor 176/Pdt.G/2021/PA.Ek menetapkan diberikan kepada ayah dengan pertimbangan menjaga agama anak sebab ibu kandung murtad sedangkan dalam Putusan Nomor 0117/Pdt.G/2016/PA.Prgi hadhanah diberikan kepada ibu kandung meskipun ibu kandung dari anak berstatus murtad dengan dasar pertimbangan menjaga jiwa, dari kedua putusan antara menjaga agama dan menjaga jiwa anak, hal yang perlu di prioritakan yakni kepentingan terbaik bagi anak sehingga pertimbangan hakim dalam memberikan hadhanah kepada ayah dengan pertimbangan ibu murtad dinilai kurang efektif sebab kelangsungan hidup anak harus lebih diutamakan karena dengan terjaganya kelangsungan hidup anak maka menjaga agama anak nantinya akan tercapai jika kelangsungan hidup anak terjaga, terlepas dari status ibu murtadi namun ibu dinilai pihak yang cukup kompeten dalam merawat anak. The research objective is to analyze the basic considerations of judges in determining hadhanah and to find out the perspective of the compilation of Islamic law in granting hadhanah. This research uses an empirical normative research type. The results of this research show that there are differences in the opinions of judges in deciding hadhanah cases where the mother is an apostate, in Decision Number 176/Pdt.G/2021/PA.Ek it is determined that it is given to the father with the consideration of protecting the child's religion because the biological mother is an apostate, whereas in Decision Number 0117/Pdt.G/2016/PA.Prgi hadhanah is given to the biological mother even though the child's biological mother has the status of an apostate based on considerations of protecting the soul, from the two decisions between protecting the religion and protecting the child's soul, things are necessary The priority is the best interests of the child so that the judge's consideration in giving hadhanah to the father considering the mother is an apostate is considered less effective because the child's survival must be prioritized because by ensuring the child's survival, safeguarding the child's religion will later be achieved if the child's survival is maintained, regardless of The mother's status is apostate but the mother is considered competent enough to care for the child.
