Abstract

AbstractTechnological developments affect international trade and e-commerce. Consumer protection is very important for Share In Jar skincare products without a distribution permit sold online to provide legal certainty. This research examines consumer protection against the circulation of Share In Jar skincare products without a distribution permit sold online, combining preventive and repressive legal approaches.The formulation of the problem that is the focus of the study is "How is consumer protection against the circulation of Share In Jar skincare without a distribution permit sold online" then, the method used in this research is through empirical juridical research, primary data in the form of interviews with consumers who have bought and used share in jar products and Pontianak Food and Drug Supervisory Center agencies, while secondary data are references related to consumer protection. Data collection and processing methods through documentation study techniques, interviews and observations. The analysis method uses qualitative descriptive analysis.  The findings in this study are that supervision and law enforcement of skincare Share-in Jar products sold online without a distribution permit from BPOM still face various challenges. BPOM already has strict regulations regarding the distribution permit of cosmetic products, but its implementation in the field is still less effective. Some of the factors that cause this are 1) Limited human resources and technology to monitor all products circulating in the online market, 2) Lack of effective cooperation between BPOM and e-commerce platforms, and slow law enforcement procedures. This causes many illegal products to remain in the market during the enforcement process.Key Words: Consumer protection, Skincare Share-in Jar, e-commerce, National Agency of Drug and Food Control  Abstrak  Perkembangan teknologi mempengaruhi perdagangan internasional dan e-commerce. Perlindungan konsumen sangat penting terhadap produk skincare Share-in Jar tanpa izin edar yang dijual online untuk memberikan kepastian hukum. Penelitian ini mengkaji perlindungan konsumen terhadap peredaran produk skincare Share-in Jar tanpa izin edar yang dijual secara online, menggabungkan pendekatan hukum preventif dan represif.Rumusan masalah yang dijadikan fokus kajian yaitu "Bagaimana perlindungan konsumen terhadap peredaran skincare Share-in Jar tanpa izin edar yang dijual secara online" lalu, metode yang digunakan dalam penelitian ini melalui riset yuridis empiris, data primer berupa hasil wawancara dengan konsumen yang pernah membeli dan menggunakan produk share in jar dan instansi Balai Besar Pengawas Obat dan Makanan Pontianak, sedangkan data sekunder berupa referensi yang berkaitan dengan perlindungan konsumen. Cara pengumpulan dan pengolahan data melalui teknik studi dokumentasi, wawancara dan observasi. Metode analisis menggunakan analisis deskriptif kualitatif.Temuan dalam penelitian ini adalah pengawasan dan penegakan hukum terhadap produk skincare Share-in Jar yang dijual secara online tanpa izin edar dari BPOM masih menghadapi berbagai tantangan. BPOM sudah memiliki peraturan yang ketat terkait izin edar produk kosmetik, tetapi implementasinya di lapangan masih kurang efektif. Beberapa faktor yang menyebabkan hal ini adalah 1) Keterbatasan sumber daya manusia dan teknologi untuk memantau seluruh produk yang beredar di pasar online, 2) Kurangnya kerjasama yang efektif antara BPOM dan platform e-commerce, serta prosedur penegakan hukum yang lambat. Hal ini menyebabkan banyak produk ilegal tetap beredar di pasaran selama proses penegakan hukum berlangsung.Kata Kunci: Perlindungan konsumen, skincare Share-in Jar, e-commerce, Balai Besar Pengawas Obat dan Makanan (BPOM)
