Abstract

Local norms and customs have an impact on the laws in Indonesia regarding the ownership of customary land by customary law communities (MHA). Even though the 1945 Constitution of the Republic of Indonesia recognizes the rights of indigenous peoples, the existing regulations lack legal certainty due to overlapping laws and regulations. The diversity of culture and relatively old society in Ethiopia make it relevant to compare regulations in Indonesia. Data collection was carried out through a library study using secondary legal data sources as the main reference base. The statutory-regulatory approach (statut approach), contextual approach (conceptual approach), and comparative approach (comparative approach) are used to examine the issue of customary land administration in Indonesia. Then the findings and data analysis will be presented in a qualitative, descriptive manner. Indonesia and Ethiopia, which have similar legal codification systems and a diversity of customs, make it easier for Indonesia to adopt Ethiopia's efforts to prosper and fulfill the interests of its MHA through continuous codification with each other in order to create legal certainty.   Hukum di Indonesia mengenai kepemilikan tanah ulayat oleh masyarakat hukum adat (MHA) dipengaruhi oleh norma dan adat istiadat setempat. Meskipun Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 mengakui hak-hak masyarakat adat, namun peraturan yang ada kurang memiliki kepastian hukum karena adanya tumpang tindih peraturan perundang-undangan. Keberagaman budaya dan masyarakat yang terhitung cukup tua di Ethiopia menjadikan relevan untuk membandingkan peraturan di Indonesia. Pengambilan data dilakukan melalui studi pustaka (library research) dengan menggunakan sumber data hukum sekunder sebagai landasan rujukan utama. Pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan komparatif (comparative approach) digunakan untuk menelaah isu penatausahaan tanah ulayat di Indonesia. Kemudian, temuan dan analisis data akan disajikan secara deskriptif kualitatif. Indonesia dan Ethiopia yang memiliki kesamaan sistem kodifikasi hukum dan keberagaman adat istiadat, memudahkan Indonesia untuk mengadopsi upaya Ethiopia dalam menyejahterakan serta memenuhi kepentingan MHAnya melalui kodifikasi yang berkesinambungan satu sama lainnya agar tercipta kepastian hukum.

Abstract

Transwomen community in the Special Region of Yogyakarta (Yogyakarta) faces distress in obtaining their social, cultural, and economic rights as part of the society. The stigma attached to them as non-conforming in the midst of Indonesian people with a majority of binary genders causes discrimination. It becomes difficult for them to access healthcare services, deal with civil registration matters, and getting proper job opportunities that often leads many of them to end up as sex workers. Although those rights should be guaranteed by the state. This research aims to analyze the implementation of equality principles based on Nussbaum’s capabilities approach theory by examining the fulfillment of the transwomen sex workers’ social, cultural, and economic rights in Yogyakarta. In-depth interview method is used for collecting empirical data. While data analysis is done through a case study approach. It is concluded that the social, cultural, and economic rights of transwomen sex workers in Yogyakarta have not been fulfilled thoroughly since only the capabilities of life, bodily health, senses, imagination, and thought, emotions, practical reason, affiliation, and other species are fulfilled. However, control over one’s environment in political context, bodily integrity, and play capabilities were not.

Abstract

The limited number of Sharia-compliant venture capital companies results in restricted access for Micro, Small, and Medium Enterprises (Usaha Mikro, Keci, dan Menengahl/UMKM) to alternative funding sources. This limitation may also stem from a lack of literacy regarding Islamic economics and finance among venture capital business players and the broader business community. Therefore, it is necessary to examine the implementation of Sharia Principles within the framework of Venture Capital Corporations (VCC) and Venture Debt Corporations (VDC), as well as the expected role of VCC and VDC in the development of UMK in Indonesia. The findings indicate that both VCC and VDC have applied Sharia principles through agreements that align with their respective characteristics. In addition to providing capital, VCC and VDC are also expected to play a role in offering management support and strategic guidance to UMKM.
