Abstract

ABSTRACT: This research is entitled a Juridical Review of the Construction of Houses on Disputed Land, Makassar District Court Case Study No 381/PDT.G/2021 PN MKS. guided by Abd. Basir and Suhartati who aim to find out the decision of the Makassar District Court regarding the construction of houses on disputed land. This type of research is Normative Juridical research, using a literature study approach that uses qualitative methods. The research results showed that the judge's legal considerations were juridically in accordance with the existing legal facts, where the Plaintiff's argument was not accompanied by facts, beliefs and corroborating evidence, so the request was rejected in its entirety because it was stated that an error had occurred. ABSTRAK:  Penelitian ini berjudul tinjauan Yuridis Terhadap Pembangunan Rumah Diatas Tanah Sengketa Studi Kasus PN Makassar No 381/PDT.G/2021 PN MKS. dibimbing oleh Abd. Basir dan Suhartati yang bertujuan untuk mengetahui putusan Pengadilan Negeri Makassar terhadap pembangunan rumah di atas tanah sengketa.  Penelitian ini adalah penelitian Yuridis Normatif, melalui pendekatan studi kepustakaan yang menggunakan metode kualitatif. Hasil penelitian menunjukkan, Pertimbangan hukum hakim secara yuridis sesuai dengan fakta-fakta hukum yang ada dimana Dalil Penggugat tidak disertai dengan fakta, keyakinan, dan alat bukti yang menguatkan, sehingga permintaan tersebut ditolak selurunya karena dinyatakan telah terjadi kekeliruan.
