Abstract

This research is useful in exploring legal protection for creditors in property security law through a comparative study of Fiduciary and Mortgage Laws. Using a normative method, a literature review serves as the primary instrument for collecting secondary data, with primary legal materials in the form of Fiduciary and Mortgage Laws, as well as laws on consumer protection and bankruptcy. Primary sources are supplemented by implementing regulations. Through analysis using legal and conceptual approaches, it was found that both laws provide protection for creditors, which can be further refined with implementing regulations to ensure equitable access to credit or debt and facilitate all parties to remain within the legal protection corridor.

Abstract

Children in Conflict with the Law have become a significant concern in Law No. 11 of 2012 concerning the Juvenile Criminal Justice System (UUSPPA). This normative juridical research will delve deeper into the legal and conceptual approaches, incorporating qualitative data analysis to formulate conclusions. Restorative justice differs from other legal approaches that focus on retribution or compensation. In the UUSPPA, the first approach aims to prioritize the interests of ABH in balance with the community's need for public order. Therefore, the resolution involves not only law enforcement officials but also community elements, families, and child protection practitioners, particularly through diversion. Therefore, prioritizing this approach is part of the legal reforms recommended to be balanced with the strengthening of legal culture.
