Abstract

Karya tulis ini mengkaji permasalahan hukum dalam praktik waralaba yang dilakukan oleh Menantea, sebuah perusahaan minuman yang mulai menawarkan jenis kerjasama berupa waralaba mulai Agustus 2021, hanya 4 (empat) bulan sejak awal berdirinya pada April 2021. Hal ini bertentangan dengan ketentuan Pasal 4 ayat (5) huruf a Peraturan Pemerintah Nomor 35 Tahun 2024 tentang Waralaba, yang mensyaratkan bahwa usaha baru dapat diwaralabakan setelah beroperasi sekurang-kurangnya tiga tahun berturut-turut. Selain itu, Menantea juga belum memenuhi kewajiban administratif berupa kepemilikan Surat Tanda Pendaftaran Waralaba (STPW) sebagaimana diatur dalam Peraturan Menteri Perdagangan Nomor 71 Tahun 2019 tentang Penyelenggaraan Waralaba. Kajian ini bertujuan untuk menganalisis bentuk pelanggaran yang terjadi, pertanggungjawaban hukum yang seharusnya dikenakan, serta perlindungan hukum bagi mitra waralaba yang dirugikan. Kajian ini disusun dengan pendekatan yuridis normatif, melalui analisis terhadap regulasi yang berlaku dan diperkuat dengan referensi dari sumber-sumber hukum yang kredibel. Temuan menunjukkan adanya pelanggaran substantif dan administratif dalam praktik waralaba Menantea, yang berimplikasi pada potensi sanksi administratif hingga pencabutan izin usaha. Kajian ini menegaskan pentingnya kepatuhan terhadap regulasi waralaba dalam rangka menjamin kepastian hukum dan perlindungan bagi mitra usaha.

Abstract

Land title certificates in Indonesia serve as strong evidence of ownership, yet their validity is relative rather than absolute and may be annulled if issuance originates from an unlawful act. This study aims to analyze the legal basis for annulling land certificates predicated upon tortious conduct and to assess the implications of such judicial action for the protection of legitimate rights holders. Employing a normative juridical method with statutory, conceptual, and case-law approaches, this research examines the Supreme Court's jurisprudence in annulling a certificate issued through an unlawful act. The findings reveal that the unlawful acts doctrine, as codified in the civil code, operates as an effective corrective mechanism against maladministration in land registration, enabling civil courts to invalidate state-issued certificates tainted by tortious conduct. The study further demonstrates that the decision reinforces the primacy of substantive justice over formal legal certainty, thereby strengthening legal protection for rightful landowners and promoting integrity within the national land administration system. This research contributes to the development of Indonesian agrarian law by clarifying the jurisprudential basis for certificate annulment and its systemic implications.

Abstract

This study examines gender-based discrimination in Indonesian workplaces, focusing on the unlawful termination of pregnant employees. Despite the existence of comprehensive labour regulations, such as “the Minister of Manpower Regulation No. 3 of 1989, Law No. 13 of 2003, as amended by Law No. 6 of 2023”, and other relevant provisions that guarantee the protection of workers’ rights, discriminatory practices against women continue to occur in various employment sectors. The case study of PT IRNC illustrates how employers unlawfully dismissed pregnant workers on illegitimate grounds, thereby violating their rights and causing both material and moral damages. Using a normative legal approach, this study affirms that such discriminatory actions constitute “a tort under Article 1365” of the Indonesian Civil Code, which holds employers legally accountable to provide compensation and reinstate affected workers. Therefore, gender discrimination in the workplace is not only an employment issue but also a form of tort that requires stricter and more consistent law enforcement. This study emphasizes the importance of increasing legal awareness, compliance, and effective implementation to ensure justice, equality, and the full protection of female workers’ rights within Indonesia’s contemporary labour law framework.
