Abstract

The rapid development of financial technology has given rise to various financial product innovations, one of which is the Buy Now, Pay Later (BNPL) service, such as SPayLater, which is increasingly popular among Indonesians. This phenomenon has created an urgent need to analyze the compatibility of this practice with Islamic economic principles. The purpose of this study is to describe and analyze the operational mechanisms of SPayLater from an Islamic economic perspective. This study uses a qualitative method with a documentary study approach. Data was collected by identifying and examining public information listed on the Shopee application regarding SPayLater products, which includes terms and conditions, cost structures, and penalty policies. The collected data was then analyzed using qualitative content analysis techniques to describe the mechanisms of the SPayLater practice organized by PT Commerce Finance and evaluate them based on Sharia law standards. The results of the study indicate that the SPayLater practice contains several elements that fundamentally contradict the principles of Islamic muamalah. Three main aspects were found that make this service haram: first, the imposition of interest on installments, which is clearly categorized as riba an-nasi'ah; second, late fees, which are also a form of riba because they are a source of income for lenders; and third, percentage-based administrative fees that contain elements of gharar (uncertainty), thus not meeting the requirement of clarity of wages (ujrah).

Abstract

Abstrak. Industri halal global berkembang menjadi ekosistem ekonomi yang kompetitif, menuntut negara mayoritas Muslim merumuskan strategi yang tepat. Studi ini dilatarbelakangi oleh kesenjangan kinerja Indonesia dan Malaysia dalam Global Islamic Economy Indicator, meskipun keduanya memiliki potensi sumber daya yang besar. Tujuan penelitian ini adalah menganalisis keunggulan kompetitif ekosistem industri halal kedua negara menggunakan kerangka Porter’s Diamond Model. Metode yang digunakan adalah kualitatif deskriptif dengan pendekatan studi kasus komparatif, menggunakan data sekunder dari laporan strategis periode 2023–2025. Hasil penelitian menunjukkan perbedaan model pengembangan yang signifikan, di mana Malaysia menampilkan tata kelola terpusat dan kematangan pembiayaan syariah melalui dominasi sukuk korporasi, sedangkan Indonesia mengandalkan model kolaboratif dengan keunggulan pada pasar domestik dan digitalisasi UMKM. Namun, integrasi instrumen keuangan syariah dengan sektor riil di Indonesia masih relatif lemah. Temuan ini berimplikasi pada perlunya penguatan tata kelola industri halal Indonesia yang berorientasi ekspor guna meningkatkan daya saing global, kontribusi sektor riil, dan kemandirian ekonomi syariah nasional.Abstract. The global halal industry has evolved into a highly competitive economic ecosystem, requiring Muslim-majority countries to formulate appropriate strategies. This study is motivated by the performance gap between Indonesia and Malaysia in the Global Islamic Economy Indicator, despite both countries possessing substantial resource potential. The objective of this study is to analyze the competitive advantages of the halal industry ecosystems in both countries using Porter’s Diamond Model framework. The research employs a descriptive qualitative method with a comparative case study approach, utilizing secondary data from strategic reports covering the 2023–2025 period. The findings reveal significant differences in development models, with Malaysia demonstrating centralized governance and advanced Islamic financing maturity through the dominance of corporate sukuk, while Indonesia relies on a collaborative model supported by a large domestic market and MSME digitalization. However, the integration of Islamic financial instruments with the real sector in Indonesia remains relatively weak. These findings imply the need to strengthen Indonesia’s halal industry governance with an export-oriented approach to enhance global competitiveness, increase the contribution of the real sector, and achieve more substantive sharia-based economic independence.
