Abstract

Inheritance law is closely related to various aspects of human life, as every individual will inevitably encounter the legal event of death. Upon the death of a person, land ownership certificates forming part of the estate are transferred to the heirs. Heirs may initiate a name transfer and certificate splitting process if there are multiple heirs. This study is a normative juridical legal research with a descriptive nature. The research employs a statutory approach and a case approach. The data used is secondary data, consisting of primary, secondary, and tertiary legal materials. Data collection techniques involve literature study, and data collection tools include document review. The data gathered is analyzed qualitatively. The findings indicate that the splitting of land certificates inherited from the deceased can be legally valid without the consent of all heirs, provided there is a court ruling in which one of the heirs has filed a lawsuit. The legal consideration of the judges in case number 137/Pdt.G/2023/PN.Mdn essentially explains that the Panel of Judges ultimately granted the Plaintiffs’ claim in full and validated the splitting of the inherited land certificate, despite the absence of the Defendants’ signatures.

Abstract

This research examines the transfer of land rights which should be conducted in accordance with Government Regulation No. 24 of 1997 and Government Regulation No. 37 of 1998 through PPAT deeds, however in practice there are still many land sale and purchase transactions that do not comply with existing statutory provisions. Using normative juridical method with descriptive analytical approach and secondary data sources through library research, this study found that court decisions can serve as the basis for land ownership transfer without PPAT deeds and provide legal certainty because they have the same evidentiary strength as authentic deeds, and in decision No. 116/Pdt.G/2021/PN Prp, the judge granted Suliyanto's lawsuit with the consideration that the land was controlled and managed by the plaintiff without objection from any party, thus ordering the transfer of certificate title from Enjum to the plaintiff at the National Land Agency Office of Rokan Hulu Regency.

Abstract

The Notary profession as a public official holds a strategic role in Indonesia's legal system, regulated through the Notary Position Law (UUJN) and the Notary Code of Ethics (KEN) by the Indonesian Notary Association (INI). However, increasing cases of alleged criminal acts by Notaries in North Sumatra raise concerns about the effectiveness of INI's legal protection. This empirical juridical research analyzes the implementation of UUJN and KEN and INI's role in providing legal protection. Results show that INI's legal protection remains suboptimal due to implementation gaps in norms, resource limitations, and weak coordination with the Notary Honor Council (MKN) and law enforcement agencies, necessitating structural reforms to ensure legal certainty for notaries.

Abstract

Indonesia applies the First to File trademark registration system based on Law No. 20 of 2016 on Trademarks and Geographical Indications which provides legal protection to the party who first registers their trademark, however its implementation faces challenges such as in the case of cancellation of the trademark "Zhe Nung Zhu & Lukisan" decided through Supreme Court Decision No. 704K/Pdt.Sus-HKI/2021. Through normative legal research with descriptive analytical approach using secondary data and qualitative analysis, it was found that the factors causing trademark cancellation include contradiction with state ideology and legislation, lack of distinctiveness, registration with bad faith, and similarity in essence with previously registered trademarks. Indonesia's trademark legal protection system implements layered mechanisms through preventive protection (administrative and substantive examination) and repressive protection (sanctions and cancellation mechanisms), where in the decision the Supreme Court applied Article 21 paragraph (1) letter a of Law No. 20 of 2016 by considering that the trademark "Zhe Nung Zhu & Lukisan" owned by Darma Iliadi has similarity in essence with the trademark "Lukisan" owned by Dhalim Soekodanu which has been registered since 1991 and was registered with bad faith, so cancellation is necessary to protect the rights of legitimate trademark owners and prevent consumer confusion.

Abstract

Land acquisition for infrastructure development in Indonesia as a developing country often leads to disputes regarding compensation determination, as in the case of Bener Dam in Purworejo Regency decided through Supreme Court Decision Number 1382 PK/Pdt/2022. This normative legal research with a descriptive-analytical approach examines compensation mechanisms based on legislation, the validity of deliberations in determining compensation, and legal considerations in dispute resolution. The results indicate that legal defects in compensation determination can occur due to non-communicative deliberation procedures, non-compliance with Law No. 2 of 2012, or violations of time limits. The Supreme Court rejected the judicial review application because the applicants failed to file objections to the District Court within 14 days as required by the applicable Supreme Court Regulations.

Abstract

Idonesia's land registration system, which applies a negative publication system with positive tendencies, has led to frequent occurrences of overlapping land certificates due to weaknesses in the verification of physical and juridical data, lack of system integration, and insufficient administrative accuracy. The research method employed is a normative juridical approach. The legal consequences of such disputes include legal uncertainty, annulment of certificates issued later due to administrative defects, reinforcement of the legal standing of certificates issued earlier based on the principle of prior in tempore potior in jure, as well as the legal liability of the National Land Agency, including the obligation to revoke defective certificates and to provide legal protection to good-faith purchasers. Supreme Court Decision Number 392 K/TUN/2022 affirms the annulment of defective certificates and emphasizes the importance of the principle of prudence as the foundation for the issuance of land certificates.

Abstract

Pejabat Pembuat Akta Tanah plays a strategic role as a public official authorized to draw up authentic deeds as well as a party responsible for ensuring the fulfillment of tax obligations, particularly the Duty on the Acquisition of Land and Building Rights (BPHTB) and Income Tax (PPh), prior to the transfer of rights. However, in Kampar Regency, practices are still found involving manipulation of transaction values, discrepancies between the Tax Object Acquisition Value (NPOP) and market prices, as well as the involvement of PPAT in assisting the reduction of transaction values in order to minimize tax burdens. Such practices potentially lead to administrative violations and undermine the principle of legal certainty. This study employs a sociological legal research method with a descriptive-analytical nature. PPAT plays a juridical, administrative, and substantive role through the verification and validation of tax payment evidence to ensure legal certainty and prevent fiscal deviations. PPAT bears juridical, administrative, and moral responsibility to ensure the compliance of the parties and to maintain the professional integrity of the office. Therefore, PPAT is advised to enhance professionalism, while the local government together with the Regional Revenue Agency (Bapenda), the National Land Agency (BPN), and the Primary Tax Office (KPP Pratama) are expected to strengthen supervisory synergy both administratively and substantively. The public is also expected to increase legal awareness regarding BPHTB and PPh obligations with proper educational support from PPAT.

Abstract

The practice of using power of attorney to sell in land sale and purchase transactions without notarial legalisation has given rise to complex legal problems because it harms the parties and creates legal uncertainty in the Indonesian land system. This study uses a normative juridical method. The results show that a power of attorney to sell affixed with a thumbprint without notarisation does not meet the formal requirements as stipulated in Article 1874 paragraph (2) of the Civil Code and Article 286 paragraph (2) of the RBg. Analysis of the legal considerations of the panel of judges in Supreme Court Decision Number 2513 K/ Pdt/2018 reveal fundamental weaknesses because they prioritise administrative aspects, thereby creating tension between the protection of bona fide buyers and substantive justice for landowners who are victims of power abuse.
