Abstract

ABSTRAK Penelitian ini bertujuan untuk mengetahui bentuk tanggung jawab hukum Bank Tabungan Negara (BTN) Cabang Pontianak atas hilangnya dana simpanan nasabah dan faktor-faktor apa saja yang menyebabkan terjadinya dana simpanan nasabah yang hilang. Penulis menggunakan metode penelitian pendekatan yuridis empiris, yaitu menggabungkan kajian terhadap peraturan perundang-undangan dengan data yang didapat melalui wawancara dengan pihak Bank BTN Cabang Pontianak dan Pengacara Credit Union. Hasil dari penelitian ini menunjukkan bahwa terjadinya dana simpanan nasabah credit union hilang sebesar Rp15.000.000.000,00 dikarenakan penyalahgunaan wewenang (fraud) yang dilakukan oleh salah satu pegawai Bank BTN Cabang Pontianak. Berdasarkan Pasal 1365 KUHPerdata, Pasal 1367 KUHPerdata, Undang-Undang Nomor 10 Tahun 1998 tentang Perbankan, Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-Undang Nomor 3 Tahun 2011 tentang Trasnfer Dana, serta Undang-Undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan (OJK) maka pihak Bank BTN Cabang Pontianak bertanggung jawab mengganti kerugian yang dialami nasabah akibat tindakan salah satu pegawainya. Faktor penyebab hilangnya dana simpanan nasabah adalah lemahnya pengawasan internal, penerapan prinsip kehati-hatian (prudential principle) yang kurang maksimal serta verifikasi transaksi yang tidak optimal. Upaya hukum yang dapat dilakukan oleh nasabah yaitu gugatan perdata berdasarkan perbuatan melawan hukum. Penelitian ini menandakan betapa pentingnya pengawasan internal dan penerapan prinsip kehati-hatian oleh bank agar menjaga kepercayaan masyarakat serta melindungi nasabah dari adanya kerugian finansial akibat fraud. Kata Kunci : Ganti Rugi, Perbuatan Melawan Hukum, Tanggung Jawab Hukum ABSTRACT This study aims to determine the legal responsibility of Bank Tabungan Negara (BTN) Pontianak Branch for the loss of customer deposits and the factors that caused the loss of customer deposits. The author uses an empirical legal research approach, which combines a review of laws and regulations with data obtained through interviews with BTN Pontianak Branch and credit union’s lawyer. The results of this study show that the loss of credit union customer deposits amounting to Rp15,000,000,000.00 was due to abuse of authority (fraud) committed by one of the employees of Bank BTN Pontianak Branch. Based on Article 1365 of the Civil Code, Article 1367 of the Civil Code, Law Number 10 of 1998 concerning Banking, Law Number 8 of 1999 concerning Consumer Protection, Law Number 3 of 2011 concerning Fund Transfers, and Law -Law Number 21 of 2011 concerning the Financial Services Authority (OJK), Bank BTN Pontianak Branch is responsible for compensating the losses suffered by customers as a result of the actions of one of its employees. The factors causing the loss of customer deposits were weak internal supervision, suboptimal application of the prudential principle, and suboptimal transaction verification. The legal action that can be taken by customers is a civil lawsuit based on unlawful acts. This study highlights the importance of internal supervision and the application of prudential principles by banks in order to maintain public trust and protect customers from financial losses due to fraud.
