Abstract

Employment contracts are intended to provide legal certainty and regulate the rights and obligations of workers and employers. However, in practice, employment agreements often contain clauses that potentially disadvantage workers, such as unclear wage provisions, unilateral sanctions, unpaid overtime, and vague termination rules. This situation commonly occurs because workers have weaker bargaining power and tend to accept contract terms without adequate explanation. This research aims to analyze the forms of employment contracts that harm workers, examine the legal protections available for workers, and describe dispute settlement mechanisms that can be pursued when workers suffer losses due to unfair contract clauses. This study uses a normative legal research method with statutory and conceptual approaches. The collected materials are analyzed qualitatively through a descriptive-analytical framework. The research findings show that clauses that contradict labor laws should not eliminate workers’ normative rights, and dispute resolution may be pursued through bipartite negotiation, mediation, and the Industrial Relations Court.Keywords: employment contract; worker protection; unfair clause; industrial relations dispute.   Abstrak Kontrak kerja seharusnya menjadi dasar kepastian hukum yang mengatur hak dan kewajiban pekerja dan pengusaha. Namun dalam praktiknya, sering ditemukan kontrak kerja yang memuat klausul yang merugikan pekerja, seperti ketentuan upah yang tidak jelas, lembur yang tidak dibayar, sanksi sepihak, serta aturan pemutusan hubungan kerja yang tidak transparan. Kondisi ini umumnya terjadi karena posisi tawar pekerja lebih lemah sehingga pekerja menerima isi kontrak tanpa penjelasan yang memadai. Penelitian ini bertujuan untuk menganalisis bentuk-bentuk kontrak kerja yang merugikan pekerja, mengkaji perlindungan hukum bagi pekerja, serta menjelaskan upaya penyelesaian sengketa yang dapat ditempuh apabila pekerja mengalami kerugian akibat klausul kontrak yang tidak adil. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa klausul yang bertentangan dengan hukum ketenagakerjaan tidak boleh menghapus hak normatif pekerja, serta penyelesaian sengketa dapat dilakukan melalui bipartit, mediasi, dan Pengadilan Hubungan Industrial. Abstract

Protection of rape victims’ rights within the Indonesian criminal justice system continues to face significant challenges, particularly regarding the role of advocates, who have traditionally focused more on assisting suspects or defendants. This study aims to analyze and describe the role of advocates in protecting the rights of rape victims, including the rights to legal assistance, restitution, and physical as well as psychological recovery. The research employs a normative juridical approach through the analysis of statutory regulations and relevant legal literature. The findings reveal that the role of advocates in assisting rape victims remains limited due to the absence of explicit provisions in the Indonesian Criminal Procedure Code (KUHAP) granting advocates full authority to represent victims throughout all stages of criminal proceedings. Consequently, victims frequently encounter obstacles in accessing justice and obtaining adequate legal protection. This condition demonstrates the need for legal reform to strengthen the position and authority of advocates in representing victims within the criminal justice process. Strengthening the role of advocates is expected to improve legal protection, ensure the fulfillment of victims’ rights, and support the recovery process for rape victims in Indonesia.
