Abstract

This research analyzes the role of advocates in the criminal justice system and identifies professional enforcement barriers in Indonesia. Using a normative legal method, the study shows that advocates are constitutionally guaranteed by Law No. 18/2003 and the 1945 Constitution to ensure due process of law and human rights protection. Advocates strategically prevent wrongful arrests, promote restorative justice, and maintain humanity in sentencing. However, effectiveness is hindered by integrity issues like the judicial mafia, limited legal aid for the poor, and potential criminalization. The research emphasizes strengthening advocates’ positions through early access to counsel, strict ethical enforcement, and independent legal protection to achieve a fair criminal justice system.
