ABSTRAK Gas LPG 3 Kg merupakan barang bersubsidi yang ditujukan bagi masyarakat berpenghasilan rendah. Namun, dalam penerapannya, harga jual LPG 3 Kg di tingkat pangkalan sering kali melampaui Harga Eceran Tertinggi (HET) yang telah ditetapkan pemerintah sebesar Rp18.500 per tabung sebagaimana diatur dalam Surat Keputusan Gubernur Kalimantan Barat Nomor 1218/RO-EKON/2022. Hasil penelitian menunjukkan bahwa harga LPG 3 Kg di lapangan mencapai Rp20.000 per tabung, sehingga merugikan konsumen karena tidak sesuai dengan ketentuan HET dan bertentangan dengan ketentuan perlindungan konsumen. Penelitian ini menggunakan metode hukum normatif empiris dengan pendekatan deskriptif kualitatif. Data diperoleh melalui wawancara langsung dengan agen dan pelaku usaha pangkalan LPG 3 Kg serta penyebaran kuesioner kepada masyarakat di Kelurahan Siantan Hulu RT 002. Data yang terkumpul dianalisis secara kualitatif. Berdasarkan hasil penelitian, perlindungan hukum bagi konsumen terhadap penjualan LPG 3 Kg bersubsidi di atas Harga Eceran Tertinggi belum terlaksana secara efektif. Penjualan di atas HET tersebut melanggar hak konsumen sebagaimana diatur dalam Pasal 4 huruf b dan huruf c Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, khususnya hak untuk memperoleh barang sesuai dengan nilai tukar yang wajar serta hak atas informasi yang benar. Selain itu, pelaku usaha juga melanggar kewajiban sebagaimana diatur dalam Pasal 7 dan larangan dalam Pasal 8 UUPK, yang secara normatif dapat dikenai sanksi pidana sebagaimana diatur dalam Pasal 62 UUPK. Pelanggaran tersebut dipengaruhi oleh lemahnya pengawasan terhadap pendistribusian LPG 3 Kg di tingkat pangkalan serta rendahnya kesadaran hukum konsumen sehingga diperlukan penegakan sanksi yang tegas terhadap pelaku usaha yang melanggar. Kata Kunci: Gas LPG 3 Kg, Harga Eceran Tertinggi, Konsumen, Perlindungan Hukum ABSTRACT Liquefied Petroleum Gas (LPG) 3 Kg is a subsidized commodity intended for low-income communities. However, in practice, the selling price of LPG 3 Kg at the base level often exceeds the Highest Retail Price (HET) set by the government at IDR 18,500 per cylinder, as stipulated in the Decree of the Governor of West Kalimantan Number 1218/RO-EKON/2022. The results of this study indicate that the market price of LPG 3 Kg reaches IDR 20,000 per cylinder, causing consumer losses due to non-compliance with the HET provisions and contradicting consumer protection regulations. This study employs a normative-empirical legal research method with a descriptive qualitative approach. Data were obtained through direct interviews with LPG 3 Kg agents and base operators, as well as the distribution of questionnaires to residents of Siantan Hulu Sub-district, RT 002. The collected data were analyzed qualitatively. Based on the research findings, legal protection for consumers against the sale of subsidized LPG 3 Kg above the Highest Retail Price has not been effectively implemented. The sale above the HET violates consumer rights as stipulated in Article 4 letters b and c of Law Number 8 of 1999 on Consumer Protection, particularly the right to obtain goods at a fair value and the right to accurate information. Furthermore, business actors have violated their obligations as regulated in Articles 7 and the prohibitions set forth in Article 8 of the Consumer Protection Law, which may be subject to criminal sanctions under Article 62 of the same law. These violations are influenced by weak supervision of LPG 3 Kg distribution at the base level and low legal awareness among consumers, thereby requiring stricter enforcement of sanctions against violating business actors.
