Abstract

Abstract This research aims to identify and analyze how legal protection is provided to consumers of nail art services based on laws and regulations, as well as the forms of legal protection for consumers who experience nail damage due to nail art services in Kubu Raya Regency, with a focus on the obligations of business actors to provide safe services in accordance with legal provisions. The research method uses a juridical sociological type with statutory and conceptual approaches. The results show that legal protection for nail art service consumers in Kubu Raya Regency has not been optimally implemented, both preventively and repressively. In practice, there are still business actors who do not provide adequate information about service risks, are not consistent in applying hygiene and sterilization standards for tools, and use nail art products that are not registered with BPOM. On the other hand, consumers who experience nail damage tend not to pursue legal remedies due to their low understanding of their rights. Keywords: Consumers Protection, Nail Art Services, Nail Damage Abstrak Penelitian ini bertujuan untuk mengetahui dan menganalisis bagaimana perlindungan hukum yang diberikan kepada konsumen pengguna jasa nail art berdasarkan peraturan perundang-undangan, serta bagaimana bentuk perlindungan hukum terhadap konsumen yang mengalami kerusakan kuku akibat penggunaan jasa nail art di Kabupaten Kubu Raya, dengan fokus pada kewajiban pelaku usaha dalam memberikan pelayanan yang aman dan sesuai dengan ketentua hukum. Metode penelitian menggunakan jenis penelitian yuridis sosiologis dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap konsumen jasa nail art di Kabupaten Kubu Raya belum terlaksana secara optimal, baik secara preventif maupun represif. Dalam praktik masih ditemukan pelaku usaha yang belum memberikan informasi risiko layanan secara memadai, belum konsisten menerapkan standar kebersihan dan sterilisasi alat, serta menggunakan produk nail art yang belum terdaftar BPOM. Di sisi lain, konsumen yang mengalami kerusakan kuku cenderung tidak menempuh upaya hukum karena rendahnya pemahaman terhadap hak-haknya.
