Abstract

Abstrak Pertumbuhan industri kedai kopi yang semakin kompetitif menempatkan inovasi resep minuman sebagai aset bernilai yang perlu dilindungi melalui rezim rahasia dagang, agar pelaku usaha tidak kehilangan keunggulan akibat kebocoran informasi, termasuk bagi kedai lokal seperti Kardja Kopi yang bergantung pada keunikan racikan resepnya.. Berdasarkan hal tersebut, penelitian ini bertujuan untuk mengetahui dan menganalisis langkah-langkah yang dilakukan oleh pemilik usaha “Kardja Kopi” dalam menjaga kerahasiaan resep kopi sebagai rahasia dagang. Penelitian menggunakan metode yuridis empiris, yaitu mengkaji ketentuan hukum positif mengenai rahasia dagang serta memadukannya dengan data lapangan yang diperoleh melalui wawancara, observasi, dan studi dokumentasi. Data primer dikumpulkan dari pemilik kafe, barista, dan supervisor, sedangkan data sekunder diperoleh dari peraturan perundang-undangan, literatur hukum, dan sumber ilmiah terkait. Hasil penelitian menunjukkan bahwa upaya perlindungan rahasia dagang di Kardja Kopi masih sangat terbatas dan belum memenuhi standar perlindungan yang ditetapkan dalam Undang-Undang Nomor 30 Tahun 2000 tentang Rahasia Dagang. Pemilik usaha belum menerapkan perjanjian kerahasiaan (NDA), belum melakukan identifikasi formal atas rahasia usaha, serta belum menerapkan kontrol akses yang memadai terhadap formula minuman. Perlindungan yang berjalan saat ini lebih bertumpu pada etika kerja, arahan lisan, dan hubungan personal antara pemilik dan karyawan. Namun, terdapat indikasi awal perlindungan di tingkat supervisor melalui klausul kontrak kerja yang memuat ketentuan kerahasiaan. Temuan tersebut menunjukkan adanya kesenjangan antara norma hukum dan praktik perlindungan rahasia dagang di usaha mikro, sehingga diperlukan penguatan kebijakan internal, penataan sistem keamanan informasi, serta penggunaan instrumen hukum tertulis agar perlindungan rahasia dagang dapat berjalan efektif. Kata Kunci: Rahasia Dagang, Kardja Kopi, Perlindungan Hukum Abstract The rapid growth of the coffee shop industry has intensified business competition, positioning beverage recipe innovation as a valuable asset that requires protection under trade secret law to prevent the loss of competitive advantage due to information leakage. This need for protection also applies to local coffee shops such as Kardja Kopi, which rely on the uniqueness of their recipe formulations as a distinctive product identity. Based on this context ,this study aims to identify and analyze the measures taken by the owner of “Kardja Kopi” to protect its coffee recipe as a trade secret. The research employs an empirical juridical method, examining the applicable legal provisions on trade secrets and integrating them with field data obtained through interviews, observations, and document analysis. Primary data were collected from the café owner, baristas, and supervisors, while secondary data were derived from legislation, legal literature, and relevant academic sources. The results indicate that the trade secret protection efforts implemented by Kardja Kopi remain limited and do not yet meet the protection standards mandated by Law Number 30 of 2000 on Trade Secrets. The business owner has not implemented Non-Disclosure Agreements (NDAs), has not formally identified or codified the confidential business information, and has not established adequate access control systems for the beverage formula. Current protection relies heavily on work ethics, verbal instructions, and personal trust between the owner and employees. However, there is an initial indication of protection at the supervisory level through employment contracts containing confidentiality provisions. These findings demonstrate a significant gap between the normative legal framework and the actual practices of trade secret protection in micro-businesses. Therefore, strengthening internal policies, improving information security measures, and utilizing written legal instruments are necessary to ensure effective protection of trade secrets.
