Abstract

Penelitian ini bertujuan untuk memahami penerapan prinsip hakim aktif (Domini Litis Principle) dalam Peradilan Tata Usaha Negara (PTUN) serta dampaknya terhadap keputusan pengadilan. Fokus kajian diarahkan pada Putusan PTUN Bandung Nomor 55/G/2012/PTUN-BDG. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan studi literatur dan analisis kasus. Data penelitian diperoleh dari dokumen hukum terkait putusan tersebut serta literatur hukum mengenai prinsip hakim aktif. Hasil penelitian menunjukkan bahwa prinsip hakim aktif tercermin dalam proses peradilan di PTUN Bandung, di mana hakim secara aktif memeriksa argumen para pihak, merujuk pada peraturan perundang-undangan, serta memberikan petunjuk selama persidangan. Penerapan prinsip ini juga tampak dalam penolakan eksepsi yang diajukan oleh tergugat. Dengan demikian, prinsip hakim aktif berperan penting dalam memastikan keadilan dan kepastian hukum dalam penyelesaian sengketa tata usaha negara. This study aims to examine the application of the active judge principle (Domini Litis Principle) in the Administrative Court (PTUN) and its impact on judicial decisions. The focus of this research is the Bandung Administrative Court Decision Number 55/G/2012/PTUN-BDG. The research employs a qualitative method with a literature review and case analysis approach. Data were obtained from legal documents related to the case and legal literature concerning the active judge principle. The findings show that the active judge principle is reflected in the proceedings of the Bandung Administrative Court, where judges actively examined the parties’ arguments, referred to statutory regulations, and provided guidance during the trial. This principle is also evident in the rejection of the defendant’s preliminary objection. Thus, the application of the active judge principle plays a crucial role in ensuring justice and legal certainty in the settlement of administrative disputes.
